If Tenant paid less than the actual amount of Tenant’s Share of Expenses specified in the statement, Tenant will pay the difference to Landlord as Additional Rent in the manner Section 2.2 describes.
In addition to Tenant’s Share of Expenses, and as a separate obligation, Tenant shall pay to Landlord, as Additional Rent, concurrently with the payment of Basic Rent, all sales, use, excise and other taxes on Rent or other amounts otherwise benefitting Landlord, as levied or assessed by governmental authorities against Landlord on account of such Rent or other amounts otherwise benefiting Landlord, or any portion thereof.
Xxxxxxxx agrees that in calculating Tenant’s Share of Expenses pursuant to this Article 3, Controllable Operating Expenses will not increase more than five percent (5%) per year, compounded annually, over the amount of such Controllable Operating Expenses for the Stabilization Year.
Landlord will also equitably adjust Tenant’s Share of Expenses Percentage for the same period to account for the reduction in the rentable area of the Premises or the Building resulting from the Taking.
