Licensee shall continue to pay the License Fee during its use of the Temporary Site, except that the License Fee shall be abated between the time the Premises and/or City Facilities are destroyed or damaged and the substitute facilities become operational.
Subject to all applicable provisions of this Agreement, including, but not limited to Sections 4, 6, 10 and 13, Licensee may construct, operate, and maintain its substitute facilities on the Temporary Site at its sole cost and expense until the earlier of (i) the expiration of the term of this Agreement; (ii) the termination of this Agreement; or (iii) the restoration and operation of Licensee’s Facilities on the Premises and/or the City Facilities.
