Technical Dispute definition

Technical Dispute has the meaning specified in Section 12.2;
Technical Dispute means a dispute that relates to a technical, engineering, operational, or accounting issue or matter related to this Agreement that, in any case, is the type of issue or matter that is reasonably susceptible to consideration by an expert in the relevant field or fields and is reasonably susceptible to resolution by such expert.
Technical Dispute means any dispute that the Parties mutually agree in writing in their reasonable discretion will primarily require the application of engineering principles or other specialized technical knowledge in order to reach resolution thereof.

Examples of Technical Dispute in a sentence

  • If the parties cannot agree that a dispute is a Technical Dispute, Section 12.1 will prevail.

  • If any dispute arises out of this Agreement (other than a dispute under Section 6.1(b) or a Technical Dispute, as defined herein), the parties will first try to resolve it amicably.

  • If any dispute arises out of this Agreement or any Product Agreement (other than a dispute under Section 6.1(b) or a Technical Dispute, as defined herein), the parties will first try to resolve it amicably.

  • Within ten Business Days after a party requests under Section 12.2 that an expert be appointed to resolve a Technical Dispute, the parties will jointly appoint a mutually acceptable expert with experience and expertise in the subject matter of the dispute.

  • In the event of any dispute arising out of or in connection with this Agreement (other than a dispute determined in accordance with Section 6.1(b) or a Technical Dispute), the parties shall first try to solve it amicably.


More Definitions of Technical Dispute

Technical Dispute shall have the meaning set forth in Section 7.5(b).
Technical Dispute a dispute between the parties that is of a technical nature concerning the interpretation of this agreement, or any document created pursuant to or incorporated by reference into this agreement or relating to the functions or capabilities of the Software or Third Party Software or the Services or any similar or related matter or that the parties agree is of a technical nature “TNP Intellectual Property” TNP work product comprising or created pursuant to the Services, the Software and any Project Documents, including without limitation original work and materials undertaken by TNP either previously or in performing its obligations under this agreement
Technical Dispute means a Dispute regarding whether the System conforms to the Industry Standards and applicable Building Codes, whether the relevant part of the Site where the System is located meets the required Site characteristics, and any other Disputes of a technical or engineering nature. All Technical Disputes shall be resolved on an accelerated basis by a nationally recognized professional expert unless otherwise agreed in writing by Contractor and District. Parties will share equally in the cost of the independent expert engaged to resolve Technical Disputes.
Technical Dispute has the meaning specified in Appendix 2;
Technical Dispute means any dispute relating to technical matters in relation to Parts A, B, C, or D of these Rules, including but not limited to technical matters relating to Kingdom;
Technical Dispute means any Dispute of a technical or operational nature relating to the design, engineering, procurement, permitting, construction, commissioning, operation or maintenance of the Unit 2 Facility which requires specialized knowledge to resolve.
Technical Dispute means any dispute which this Agreement expressly provides shall be a Technical Dispute.
