Except for the notice required by Section 6.0, as authorized by the Act (including the provisions of HB 15-1348), with respect to this Plan only, each Taxing Body hereby waives any provision of the Act that provides for notice to any or all of the Taxing Bodies, requires any filing with or by the Taxing Bodies, requires or permits consent from each Taxing Body, and provides any enforcement right to each Taxing Body for the Duration.
In the case of Taxing Body Representatives, their term will be for the duration of their employment in their position at said Taxing Body or until their organization desires to replace them.
For each of the tax years from 2017 through 2020, to the extent the Property Tax Xxxx for the Station exceeds the Annual Minimum Tax Amount for any Taxing Body, each such Taxing Body shall accept the Credits as payment by Dynegy for amounts due from Dynegy over and above the Annual Minimum Tax Amount.
Under the constitution and statutes of the State of Tennessee, a Housing Project may be exempt from all real and personal property taxes and special assessments levied or imposed by any Taxing Body.
Dynegy shall be entitled to apply the Credits to reduce Dynegy’s Property Tax Xxxx, or its cash payment of the Property Tax Xxxx, attributable to such Taxing Body to the Annual Minimum Tax Amount for that Taxing Body.
