Target ERISA Affiliate definition

Target ERISA Affiliate means any Person that, together with the Target, would be treated as a single employer within the meaning of Section 414(b), (c), (m) or (o) of the Code.
Target ERISA Affiliate means any business or entity which is a member of the same "controlled group of corporations," under "common control" with or an "affiliated service group" of Target within the meanings of Sections 414(b), (c) or (m) of the Code, or required to be aggregated with Target under Section 414(o) of the Code, or is under "common control" with Target, within the meaning of Section 4001(a)(14) of ERISA, or any regulations promulgated or proposed under any of the foregoing sections.
Target ERISA Affiliate has the meaning given to that term in Section 2.10(a) of this Agreement.

  • Canadian Benefit Plans means all material employee benefit plans of any nature or kind whatsoever that are not Canadian Pension Plans and are maintained or contributed to by any Credit Party having employees in Canada.

  • Foreign Benefit Plan means any Employee Benefit Plan established, maintained or contributed to outside of the United States of America or which covers any employee working or residing outside of the United States.
