System Performance shall have the meaning specified in Section 2.2 (Definitions) of Exhibit D (Service Level Agreement).

System Performance means: the System’s page load times for all customary inputs and updates. You can access the System and, when performing all routine functions, will have responsive System Performance as set forth in the Service Level. Ninety-nine and five- tenths percent (99.5%) System Availability per calendar month. Average System Performance under seven seconds per calendar month. System Performance means the com- plete behavior of a repository system in response to the conditions, proc- esses, and events that may affect it. Tectonic means of, or pertaining to, the forces involved in, or the resulting structures or features of, tectonics. Tectonics means the branch of geol- ogy dealing with the broad architec- ture of the outer part of the Earth, that is, the regional assembling of structural or deformational features and the study of their mutual rela- tions, origin, and historical evolution. To the extent practicable means the de- gree to which an intended course of ac- tion is capable of being effected in a manner that is reasonable and feasible within a framework of constraints. Underground facility means the under- ground structure and the rock required for support, including mined openings and backfill materials, but excluding shafts, boreholes, and their seals. Unsaturated zone means the zone be- tween the land surface and the water table. Generally, water in this zone is under less than atmospheric pressure, and some of the voids may contain air or other gases at atmospheric pressure. Beneath flooded areas or in perched § 960.3 water bodies, the water pressure lo- cally may be greater than atmospheric. Waste form means the radioactive waste materials and any encapsulating or stabilizing matrix.
System Performance. The Services provided by the MerlinOne System and network will meet or exceed the System performance requirements stated in Paragraph 1.2.3 above. If these performance levels are not met, then, MerlinOne will provide Customer with the following credits on the next invoice:

System Performance. CATEGORY: OSS draft document, Revision 0.7, dated June 17, 1997 entitled "Key Metrics for System Performance Document" (as referred to as the "System Performance Standards Document"). This document identifies the network-wide key metrics for Ericsson and Lucent switching systems, as well as cell sites, which will provide a high level assessment of the system. These Network Standards Documents are, subject to the terms and conditions of this Agreement including, without limitation, this Schedule E-3, hereby incorporated into and form a part of this Agreement. In the event of any inconsistency between any part of a Network Standards Document and the provisions of this Schedule E-3, the provisions of this Schedule E-3 shall govern. Set out below is a brief description of each Category of Network Standard and the currently established metrics for each such Category.
System Performance is measured by the “Average Bet Placement Time” for each full hour starting each day at 00:00:00 (e.g. 03:00:00 to 03:59:59).
