Substantial Performance of the Work definition

Substantial Performance of the Work has the meaning given to it in the Construction Contract.

Substantial Performance of the Work means the time when the prerequisites to Substantial Performance of the Work required by the Contract are fulfilled and the Work is ready for use or is being used for the purpose intended and the state of the work is so declared, in writing, by the Owner.

Substantial Performance of the Work means Substantial Performance of the Work is as defined in the lien legislation applicable to the Place of the Work. If such legislation is not in force or does not contain such definition, Substantial Performance of the Work shall have been reached when the Work is ready for use or is being used for the purpose intended and is so certified by the Owner.

Examples of Substantial Performance of the Work in a sentence

• Substantial Performance Date means the date Substantial Performance of the Work is achieved.

• Warranty Period means the warranty period under the Agreement in respect of the Work (except for the Extended Warranty Periods as described in GC 9.3.6), which is two (2) years from the date of Substantial Performance of the Work or such other period as may be specified in row C.6 of the Information Sheet or elsewhere in the Agreement.

• Scheduled Date for Substantial Performance of the Work means the scheduled date for Substantial Performance of the Work as set out in row C.4 of the Information Sheet, or if no such date is set out, the number of Calendar Days or Working Days after the Commencement Date specified in row C.4 of the Information Sheet.

• If such legislation is not in force or does not contain such definition, or if the Work is governed by the Civil Code of Quebec, Substantial Performance of the Work shall have been reached when the Work is ready for use or is being used for the purpose intended and is so certified by the Consultant.

• Substantial Performance of the Work Substantial Performance of the Work is as defined in the lien legislation applicable to the Place of the Work.

More Definitions of Substantial Performance of the Work

Substantial Performance of the Work means that the Contract has been “completed” as the term is defined in the Builders’ Lien Act;

Substantial Performance of the Work means when the Contract is deemed to be substantially performed pursuant to the Construction Act, R.S.O. 1990, c. C.30, as such statute is amended or replaced from time to time. If such legislation is not in force or does not contain such definition, Substantial Performance of the Work shall have been reached when the Work is ready for use or is being used for the purpose intended and is so certified by the Town, or, if a Consultant has been appointed, by the Consultant;

Substantial Performance of the Work or “Substantial Performance” means when the requirements of section 2(1) and, if applicable, section 2(2) of the Construction Act are certified as achieved or deemed achieved, in accordance with the Construction Act.

Substantial Performance of the Work has the meaning given to “substantial performance” in the Construction Lien Act (Ontario).

Substantial Performance of the Work is as defined in The Builders’ Liens Act, C.C.S.M. c.B91.

Substantial Performance of the Work has the meaning set forth in the Craft Construction Contract.

Substantial Performance of the Work shall have the meaning set out in the lien legislation applicable to the Property. If such legislation is not in force or does not contain such definition, or if the Work is governed by the Civil Code of Quebec, Substantial Performance of the Work shall have been reached when the Work is ready for use or is being used for the purpose intended and is so certified by the Architect.
