Subject Tank definition

Subject Tank has the meaning set forth in Section 32(g).

  • If Tesoro makes an offer on terms no less favorable to TLO than the third-party offer for a Storage Contract with respect to such Subject Tank during the Offer Period, then TLO shall be obligated to enter into a Storage Contract with Tesoro.

  • If TRMC makes an offer on terms no less favorable to THPP than the third-party offer for a Storage Contract with respect to such Subject Tank during the Offer Period, then THPP shall be obligated to enter into a Storage Contract with TRMC.

  • Tank means an enclosed space which is formed by the permanent structure of a ship and which is designed for the carriage of liquid in bulk.

  • Underground storage tank or “UST” means any one or combination of tanks (including underground pipes connected thereto) that is used to contain an accumulation of regulated substances, and the volume of which (including the volume of underground pipes connected thereto) is 10 percent or more beneath the surface of the ground. This term does not include any:

  • Storage tank means an aboveground storage tank or underground storage tank as defined by this Regulation.

  • Aboveground storage tank shall have the meaning ascribed to such term in Section 6901 et seq., as amended, of RCRA, or any applicable state or local statute, law, ordinance, code, rule, regulation, order ruling, or decree governing aboveground storage tanks.

  • Underground mining means all methods of mining other than surface mining.

  • Remediation Period has the meaning specified in Section 8.2(a);

  • Clean-Up Period has the meaning specified in Section 8.02(b).

  • Cooling Off Period means the duration of time counted from the date when the direct seller and the direct selling entity enter into an agreement and ending with the date on which the contract is to be performed and within which direct seller may repudiate the agreement without being subject to penalty for breach of contract.

  • BPD means barrels per day.
