Stop Payment Orders. If you don t want us to pay a specific written instrument such as a personal check, you can ask us to place a Stop Payment Order or (“SPO”) on the instrument. You can notify us by mail, telephone, electronically, or in person. Any such instruction must be given to an employee of the Credit Union. Your SPO will take effect when we record it on your account. A SPO will not be valid and binding on us unless your SPO includes your account number, the number and date of the written instrument, the name(s) of the payee(s), and the exact amount of the instrument. Only the person placing the SPO may release the SPO. We will charge you a service charge for any SPO as set forth in the Schedule. If you give an oral SPO that is not confirmed in writing by you or us within fourteen (14) days, your SPO will expire and the instrument may thereafter be paid by us. If you provide written confirmation, your SPO will be effective for a period of six (6) months. Alternately, the Credit Union, in its sole discretion, may confirm any oral SPO in writing by sending a notice to the address shown in our records, but has no obligation to do so. Such written confirmation by us will also be effective for a period of six (6) months. To extend the SPO for an additional six (6) months, you must deliver to us an additional written request as described above. The Credit Union will not be responsible for any loss as a result of honoring a check: (1) more than fourteen (14) days after receipt of your oral order to stop payment; (2) more than six (6) months after your written order to stop payment, our written confirmation, or more than six (6) months after a written extension as provided herein; (3) through inadvertence, oversight or accident, we honor any postdated check; (4) if you fail to provide us with complete or accurate information; (5) or fail to meet your obligations as noted in this section or otherwise in this Agreement. We have no obligation to accept any order to stop payment on any certified check, cashier's check, teller's check or other instrument guaranteed by us. Stop Payment Orders. If you do not want us to pay a check drawn on your account, you have a right to request that we do not pay the check. We will accept a stop payment request from any account owner, regardless of which account owner signed the check. Any account owner may cancel a stop payment order. You can exercise this right by notifying us in person or by writing or calling us. You may generally stop payment on a check drawn on your account, provided that we have not accepted, certified, paid in cash, made final payment on or otherwise become accountable for such check, except to the extent otherwise required by Applicable Law. Stop payment requests must be timely and describe the check by the exact account number, check number and amount of the check. You must also provide any other information we reasonably request that would assist us in identifying the check (for example, the name of the person the check is made out to and the date of the check). We must be given a reasonable opportunity to act on any stop payment request before it can be considered effective. Your stop payment request will generally be effective when it is processed in your account. If the information you give us is not correct, does not reasonably describe the check or is not provided timely so as to give us a reasonable opportunity to act on your request, we are not responsible if we are not able to stop payment on the check. Oral stop payment requests received by our Customer Care Center and stop payment requests submitted through On-Line Banking are treated as written requests due to the authentication process that occurs and the record created from the request and are valid for 6 months. Oral stop payment requests not received by our Customer Care Center are only valid for 14 days, although we may, in our sole discretion, extend the time that your oral stop payment request is valid. If you would like your oral stop payment request to remain effective for longer than 14 days, you must provide us with a written stop payment request. If you do not confirm your oral stop payment request in writing during this time period and the check is presented to us for payment following the expiration of this time period, we may pay it without notice and without any liability to you. Stop Payment Orders. You may place stop payment orders through Online Services on checks, preauthorized electronic fund transfers and payments, and ACH debits that have not yet posted to your account. Stop payment orders are processed or responded to on the same business day as received. Orders received after close of business will be processed on the following business day. Stop Payment Orders. You may order us to stop payment on a check, but we must have a reasonable opportunity to verify that the item is unpaid and to act on the order after receiving it. Because we rely upon computer systems to implement stop payment orders, you understand that your order must provide the exact amount, check number and account number on the item you want stopped. We are not responsible for paying items that do not exactly match your stop payment order. Your stop payment order should also identify the payee of the item so that we may verify we are stopping payment on the correct item. A stop payment order is only effective for six (6) months, unless renewed in writing. When the stop payment order expires, we may pay the item and have no duty to notify you. If we give you a confirmation of your stop payment order, you agree to notify us immediately if it is inaccurate and in the absence of such notification, you agree that we will not be responsible for relying on the information in the confirmation. You understand that we may not be able to stop payment on items that you have enabled third parties to create and send to us. If you have authorized a third party to initiate recurring deductions from your account, you should order the third party to stop them, and agree that we are not responsible therefor except to the extent required by law. You may not stop payment on certified checks, teller’s checks or cashier's checks or money orders and understand that we may refuse to issue a replacement or to refund the check amount before the expiration of a period of time specified by applicable law. You understand that a stop payment order on any check will not preclude a holder-in-due course from making a claim against you. You assign to us all rights against the payee or any other holder of the item. You agree to fully cooperate with us in any legal actions that we may take against such persons. A fee may apply.
Stop Payment Orders. If You request us to stop payment on an item, We will make a good faith effort to do so. The stop payment order must describe the check with reasonable certainty. If the stop payment order does not do so or if We do not have a reasonable opportunity to act on it, We will not be liable if We do not stop payment, or if our payment of the item(s), causes other items to be returned for insufficient funds. If We do stop payment of an item at Your direction, You agree to pay all costs We may incur as a result. An oral stop payment order expires after 14 days unless We receive written confirmation from You within that time. A stop payment order is only good for 180 days, but You may renew it by written request that We receive before it expires.
Stop Payment Orders. You agree that our rules for stopping payment on ordinary checks apply to stopping payment on your Convenience Checks. If you ask us to stop payment or renew a stop payment order, you will be charged our standard stop payment fee as set forth on our Truth in Savings Fee Schedule for each order or renewal of an order.
Stop Payment Orders. If the Internet services include the ability to request stop payments on checks, or delays in payments of post dated checks, the Bank will not be required to act on such instructions until 4 hours after the notice is received by the Bank, or until 11:00 am on the next business day if the 4 hours would end after the normal business hours of the Bank. You should call the Bank if you wish your instructions to be acted on more quickly. There will be a fee of $25.00 for any stop payment placed on an item.

Xxxxxxxx must be in writing and may be made from time to time. A written stop order, renewal or revocation will be valid upon delivery to the Credit Union. In order to place a stop payment order, you must inform the Credit Union of the exact amount of the item and the number of the check and the number of the account. The Credit Union will not be responsible if the information you give is not correct or if you fail to give any other reasonable information regarding the item and the stop payment cannot be completed. The Credit Union is entitled to a reasonable period of time after you give a stop order to notify its employees. If the Credit Union re-credits your account after paying a check over a valid and timely stop order, you agree to transfer to the Credit Union all of your rights against the payee or other holder of the check, and to assist the Credit Union in legal action taken against that person later on. A release or cancellation of a stop order may be given by any person who is authorized to draw checks against the account. Stop payment orders on cashier’s checks and certified checks are not permitted.
