Statement of Operating Conditions definition

Statement of Operating Conditions means the Rules, Regulations, and Rate Schedules on file with the Federal Energy Regulatory Commission, as amended from time to time.
Statement of Operating Conditions or “SOC” means this Statement of Operating Conditions setting forth Transporter’s terms and conditions of service.
Statement of Operating Conditions means this document in its entirety including the General Terms and Conditions of Service, Rate Summary, Form of Storage Services Agreement, Service Schedules for FSS and STS Service, Form of Letter of Credit and Form of Guarantee;

  • The captions or headings preceding the various parts of this Statement of Operating Conditions are inserted and included solely for convenience and will never be considered or given any effect in construing this Statement of Operating Conditions, or in connection with the intent, duties, obligations, or liabilities of Transporter and Shipper.

  • This Statement of Operating Conditions, the Service Agreement and its applicable Confirmation are binding upon and will inure to the benefit of the parties and their respective successors, assigns and legal representatives.

  • Variances from the terms of the Statement of Operating Conditions, Service Agreement, or any applicable Confirmation shall not be considered to amend or alter the construction or interpretation of the Service Agreement or any applicable Confirmation.

  • Subject to the other terms and conditions of this Statement of Operating Conditions, the Service Agreement and any applicable Confirmation, each party has the right to treat, process, and/or dehydrate the Gas prior to delivering said Gas to the other party.

  • Unless otherwise stated herein, all capitalized terms herein shall have the meaning ascribed to them in the Statement of Operating Conditions.

  • A Service Agreement is required for all services hereunder and will be subject to all terms and provisions of this Statement of Operating Conditions, its applicable Confirmation and any applicable Agency Agreement.

  • Transportation Fees and other charges due under this Statement of Operating Conditions, the Service Agreement, its applicable Confirmation or any Agency Agreement Shipper may execute will be invoiced and payable under Section 5 of the General Terms and Conditions.

  • Nothing contained in this Statement of Operating Conditions, the Service Agreement or any applicable Confirmation, either express or implied, confers any rights, remedies, or claims upon any person or entity not a party to the Service Agreement or any applicable Confirmation, other than the successors or permitted assigns of the parties.

  • Normal Operating Conditions means those Service conditions which are within the control of Grantee. Those conditions which are not within the control of Grantee include, but are not limited to, natural disasters, civil disturbances, power outages, telephone network outages, and severe or unusual weather conditions. Those conditions which are ordinarily within the control of Grantee include, but are not limited to, special promotions, pay-per-view events, rate increases, regular peak or seasonal demand periods, and maintenance or upgrade of the Cable System.

  • Commencement of Operations means, with respect to any Facility, the completion and the performance of all of the following activities:

  • CT conditions of operation means all selectable parameters governing the operation of a CT X-ray system including, but not limited to, nominal tomographic section thickness, filtration, and the technique factors as defined in 41.1(2).

  • Plan of operation means the plan of operation of the program

  • Areas of Operations means the locations where PURCHASER performs the operations described in the contract.

  • Certificate of operation means a document issued by the administrator or an approved local jurisdiction for a conveyance indicating that the conveyance has been inspected by the administrator, an approved local jurisdiction, or a licensed third-party conveyance inspector and approved under this article.

  • Financials means the annual or quarterly financial statements, and accompanying certificates and other documents, of the Borrower and its Subsidiaries required to be delivered pursuant to Section 5.01(a) or 5.01(b).

  • Area of operation means the area from which the persons can be admitted as members of the Bank.

  • AREA OF OPERATIONS means the Company's oilfield operations in the States of Assam and Arunachal Pradesh.

  • Hours of Operation are the hours established by the Employer to provide adequate service to the public and to fulfil the functions of the work unit.

  • Independent Financial Consultant means a financial consultant or firm of such consultants generally recognized to be well qualified in the financial consulting field, appointed and paid by the District, who, or each of whom:

  • Compliance Statement is that certain statement in the form attached hereto as Exhibit B.

  • Audited financial report means and includes those items specified in Section 5 of this regulation.

  • Financial Statements Date shall have the meaning ascribed to it in Section 3.7.

  • Financial Monitoring Report or “FMR” means each report prepared in accordance with Section 4.02 of this Agreement;

  • Business Condition of any Person shall mean the condition (financial or other), earnings, results of operations, business, properties or prospects of such Person.

  • Parent Financial Statements has the meaning set forth in Section 4.6(a).

  • Target Financial Statements has the meaning set forth in Section 3.4(a).

  • Company Audited Financial Statements has the meaning set forth in Section 3.11.

  • Financial Report means the annual financial report prepared under Chapter 2M of the Corporations Act for the Company and its controlled entities;
