Specially Written Software definition

Specially Written Software means any software created by the Contractor (or by a third party on behalf of the Contractor) specifically for the purposes of this Contract.
Specially Written Software means any software created by the SERVICE PROVIDER (or by a third party on behalf of the SERVICE PROVIDER, including by any Sub-Contractor) specifically for the purposes of this Contract.
Specially Written Software means any software (including database software, linking instructions, test scripts, compilation instructions and test instructions) created by the Supplier (or by a Sub-Contractor or other third party on behalf of the Supplier) specifically for the purposes of this Call Off Contract, including any modifications or enhancements to Supplier Software or Third Party Software created specifically for the purposes of this Call Off Contract;

Examples of Specially Written Software in a sentence

  • Customer’s right to sub-license The Customer shall be freely entitled to sub-license the rights granted to it pursuant to Clause 33.2.1 (Licences granted by the Supplier: Specially Written Software and Project Specific IPR).

  • Allocation of title to IPR Save as expressly granted elsewhere under this Call Off Contract: the Customer shall not acquire any right, title or interest in or to the Intellectual Property Rights of the Supplier or its licensors, including: in the Supplier Software; the Supplier Background IPR; in the Third Party Software; the Third Party IPR; in the Specially Written Software; and the Project Specific IPR.

  • Where the Contractor identifies an opportunity for exploitation of any of the Specially Written Software or Project Specific IPR, the Contractor shall develop and submit to the Authority a proposal for such commercial exploitation.

  • The Contractor will deliver to the Authority the Specially Written Software in both Source Code and binary code forms within seven (7) Days of a written request and shall provide updates of the Source Code on each new release, patch or new version of the Specially Written Software on media that are reasonably acceptable to the Authority.

  • If requested to do so by the Authority, the Contractor shall without charge to the Authority execute all documents and do all such further acts as the Authority may require to perfect the assignment under clause 58.4.1 (Project Specific IPR and Specially Written Software) or shall procure that the owner of the Project Specific IPR and the Specially Written Software does so on the same basis.

Specially Written Software means any software (including database software, linking instructions, test scripts, compilation instructions and test instructions) created by the Subcontractor (or by a sub-sub-contractor or other third party on behalf of the Subcontractor) specifically for the purposes of this Agreement, including any modifications, configuration, customisation, or enhancements to Subcontractor Software or Third Party Software created specifically for the purposes of this Agreement;
Specially Written Software means any software created by the Supplier (or by a third party on behalf of the Supplier, including by any Sub-Contractor) specifically for the purposes of this Contract and shall consist of any programs, codes and software written by or on behalf of the Supplier for use by the Supplier specifically in the provision of the Services (including any modifications or enhancements made to such software during the Contract Period);
Specially Written Software any software (including database software, linking instructions, test scripts, compilation instructions and test instructions) created by the Supplier (or by a Sub-contractor or other third party on behalf of the Supplier) specifically for the purposes of this Agreement, including any modifications or enhancements to Supplier Software or Third Party Software created specifically for the purposes of this Agreement;
Specially Written Software means: i) the software identified as Specially Written Software in the Contract; and ii) any software specifically written by or on behalf of the Contractor in order to comply with its obligations under this Contract.

Specially Written Software means any software created by the Supplier (or by a third party on behalf of the Supplier, including by any Sub- contractor) specifically for the purposes of this Contract and shall consist of any programs, codes and software written by or on behalf of the Supplier for use by the Supplier specifically in the provision of the Services (including any modifications or enhancements made to such software during the Contract Period) and shall include the items listed as Specially Written Software in paragraph 4 of the Order Form;
Specially Written Software means any software: (a) which is used by any Supplier Person to provide the Services (or is made available to the DCC as part of the Services); and (b) which is created by the Supplier or any other Supplier Person (or by a third party on behalf of the Supplier or a Supplier Person) specifically for the purposes of this Agreement; "Specific Change in Mandatory Requirements" means any Change in Mandatory Requirements that relates specifically to the activities of the DCC or any DCC Service User conducted pursuant to a licence granted under section 6(1)(c), 6(1)(d) or 6(1)(f) or 6(1A) and 6(1C) of the Electricity Act 1989 or section 7, 7A(1) or 7AB(1) or 7AB(2) and 7AB(4) of the Gas Act 1986, including a change to any of the following: (a) the SEC; (b) any of the Industry Codes and Arrangements; or (c) the DCC Licence;
