Software Error definition

Software Error means a reproducible defect or combination thereof in the Software that results in a failure of the Software when used in accordance with the Documentation. Software Errors do not include those errors caused by (a) Licensee’s negligence, (b) any unauthorized modification or alteration Licensee makes to the Software, (c) data that does not conform to Licensor’s specified data format, (d) operator error, or (e) use not conforming to the Licensor’s supported technical environment specified in the Documentation.
Software Error means a failure of any Software or SaaS Services to materially conform to its applicable standard end user documentation provided by us (“Documentation”), provided that such failure can be reproduced and verified by us using the most recent version (including all available updates, application packs, and releases) of such Software or SaaS Service made available to you, and further provided that Software Errors do not include any nonconformity to applicable Documentation caused by your material breach of the Agreement, or your unauthorized modification or misuse of the Software or SaaS Services.
Software Error means a failure of any Software materially and substantially to conform to applicable Documentation, provided that such failure can be reproduced and verified by Blackboard using the most recent Version (including all available Corrections, Application Packs, Updates, and Upgrades) of such Software made available to Customer, and further provided that Software Errors do not include any nonconformity to applicable Documentation caused by: (i) Customer’s or its end users’ negligence, (ii) any modification or alteration to the Software not made by Blackboard, (iii) data that does not conform to Blackboard’s specified data format, (iv) operator error, (v) use on any system other than the operating system specified in the Documentation, (vi) accident, misuse or any other cause which, in Blackboard’s reasonable determination, is not inherent in the Software, or (vii) any use of the Software other than expressly authorized in this Schedule.

Examples of Software Error in a sentence

  • When a Severity Level 1 Software Error is reported, Licensor will assign resources necessary to correct the Software Error.

  • Severity Level 3 implies a Software Error such that implementations of function do not match specification and/or technical Documentation, and a workaround may exist.

  • If the cause of an Incident is a Software Error as defined under Section 3.2.2 a Qualified Error Report will be provided.

  • Upon discovery of a SaaS Software Error, City agrees, if requested by Contractor, to submit to Contractor a listing of output and any other data that Contractor may require in order to reproduce the SaaS Software Error and the operating conditions under which the SaaS Software Error occurred or was discovered.

  • If the Error can be reproduced, Exacloud will inform the Customer within the Processing Time whether the cause is a Software Error and will provide an estimated time until a solution or fix is available („Qualified Response“).


More Definitions of Software Error

Software Error means an instance of failure of the Software to be operative as further defined by Swisslog.
Software Error means any software instruction or statement contained in or absent from the Licensed Programs, which, by its presence or absence, prevents the Licensed Programs from operating in accordance with the Specifications.
Software Error means an error which allows the program execution to complete and yield results that may be wrong but not easily identifiable as incorrect.
