Site Contamination definition

Site Contamination means Hazardous Substances, pollutants, or contaminants on, under or emanating from the Site, comprising tar, asphalt, petroleum hydrocarbons, polycyclic aromatic hydrocarbons (“PAHs”) and other substances identified as constituents of concern at the Site in DEP’s Uncontrolled Hazardous Substances Site Program Decision Document dated August 17, 2005, but shall not include any such substances that are spilled, discharged, emitted, or disposed of at the Site after the Effective Date of this Consent Decree.
Site Contamination has the meaning given to that term in the EP Act;
Site Contamination means any releases or threatened releases of hazardous substances that occurred or are occurring on or before the Effective Date at or from mining-related sources in Colorado within the BPMD.

  • The Franchisee must, at the request of the State, obtain the opinion of an independent consultant with experience in Contamination of a similar nature and scale to the Site Contamination as to the nature, cause and extent of the Site Contamination notified under clause 7.5(c), appropriate remediation measures to address the Site Contamination and an estimate of the cost of such remediation measures.

  • The Contribution Percentages in no way reflect any final, negotiated allocation of responsibility for costs associated with investigating and remediating any Site Contamination and shall not be asserted as such.

  • The Parties will share the costs of the RI Work and may, upon further written agreement or amendment of this Agreement, share the costs of certain additional specified tasks relating to the investigation and remediation of Site Contamination.

  • If the Exit ESA reveals EGX’s non- compliance with any Environmental Law, the provisions of this Lease relating to Paragraph 12.9. Site Contamination will apply.

Site Contamination means environmental pollution, contamination, degradation, damages, exposure or injury to property caused by, relating to, arising from, or in connection with the generation, handling, use, treatment, storage, transportation, disposal, discharge, presence, Release, threatened Release, or emission of any substance within, at, on or underlying the SUMF Assets or any of the land or groundwater underlying any of the SUMF Assets.

  • Hazardous Materials Contamination means contamination (whether now existing or hereafter occurring) of the improvements, buildings, facilities, personalty, soil, groundwater, air or other elements on or of the relevant property by Hazardous Materials, or any derivatives thereof, or on or of any other property as a result of Hazardous Materials, or any derivatives thereof, generated on, emanating from or disposed of in connection with the relevant property.

  • Contamination means the presence of, or Release on, under, from or to the environment of any Hazardous Substance, except the routine storage and use of Hazardous Substances from time to time in the ordinary course of business, in compliance with Environmental Laws and with good commercial practice.

  • Hazardous Materials means all explosive or radioactive substances or wastes and all hazardous or toxic substances, wastes or other pollutants, including petroleum or petroleum distillates, asbestos or asbestos containing materials, polychlorinated biphenyls, radon gas, infectious or medical wastes and all other substances or wastes of any nature regulated pursuant to any Environmental Law.
