Settlement Costs definition

Settlement Costs means all costs incurred by Plaintiff, the Settlement Class Members, and their attorneys, including but not limited to Plaintiff’s attorneys’ fees, costs of suit, Plaintiff’s expert or consultant fees, any incentive payments paid to the Class Representative, notice costs, costs of claims administration, and all other costs of administering the Settlement Agreement.

Settlement Costs means the following, when they arise from a “claim”:

Settlement Costs means all costs of the settlement including the costs of carrying out the Notice Program, as set forth in Paragraph 4, Claims Administration, any Attorneys’ Fees and Expenses Award, any Service Award to Representative Plaintiffs and all other expenses or costs related to the settlement including the costs of serving notices under the Class Action Fairness Act of 2005, 28 U.S.C. § 1715, and Award payments to the Settlement Class Members.

Examples of Settlement Costs in a sentence

• Where the Department accepts the DRB's ruling and the quantity of additional compensation and contract time associated with the dispute exceeds the amounts of the most recently updated Engineer's Estimate and Entitlement Analysis, then the DRB's recommendation should be used as justification for and made a part of the Statement of Claim Settlement Costs (see CPAM Section 7.5.3).

• All costs of such research will be considered Settlement Costs and deducted from the Settlement Fund.

• The Settlement Administrator shall perform skip tracing for all returned direct mail; all costs of skip tracing will be considered Settlement Costs and paid from the Settlement Fund.

• All costs of address confirmation, data searches, and re-mailing of Returned Settlement Notices will be considered Settlement Costs and deducted from the Settlement Fund.

• The amount of each Cash Award will be determined by the following formula: (Total Settlement Fund – Settlement Costs) ÷ (Total Number of Approved Claims) = Cash Award.

Settlement Costs means costs incurred by the Settlement Body in connection with the performance of its functions under electricity capacity regulations and capacity market rules;
