Settlement Class Members definition

Settlement Class Members means a member of a Settlement Class.
Settlement Class Members means all Persons who are members of the Settlement Class.
Settlement Class Members means a Person(s) who falls within the definition of the Settlement Class.

Examples of Settlement Class Members in a sentence

  • Those Settlement Class Members whose cash benefit checks are not cleared within one hundred eighty (180) days after issuance will be ineligible to receive a cash settlement benefit from the Settlement Fund, and Defendant will have no further obligation to make any payment pursuant to this Agreement or otherwise to such Settlement Class Members.

  • If the amount awarded is less than the amount requested by Class Counsel for Attorneys’ Fees and Cost Award, the difference shall remain in the Settlement Fund and be available for distribution to Settlement Class Members.

  • The time periods and/or dates described in this Agreement with respect to the giving of notices and hearings are subject to approval and change by the Court or by the written agreement of Class Counsel and Defendant’s Counsel, without notice to Settlement Class Members.

  • If approved by the Court, a Settlement Fund will be created totaling up to $3,365,000.00, which will be used to pay claims submitted by Settlement Class Members, Class Counsel’s attorney’s fees up to $1,009,500.00 (30% of the Settlement Fund) and costs up to $150,000, and a service award to the Class Representative up to $10,000, as approved by the Court.

  • Solely for the purpose of this Settlement, the Parties stipulate and agree to certification of the claims asserted on behalf of Settlement Class Members.


More Definitions of Settlement Class Members

Settlement Class Members means, individually or collectively, members of the Settlement Class who do not timely and validly request exclusion from the Settlement Class in accordance with paragraph 9 hereof.
Settlement Class Members means members of the Settlement Class who did not opt out of the Settlement.
Settlement Class Members means all individuals in the Settlement Class, including the Plaintiffs. Settlement Class Members shall not be permitted to exclude themselves from the Settlement Class.
Settlement Class Members means Class Members who have not submitted a timely and valid Request for Exclusion pursuant to Paragraph 48.
Settlement Class Members means each and every member of the Settlement Class, except those who elect to opt-out or are otherwise excluded from the Settlement Class in accordance with this Agreement.
Settlement Class Members means and refer to those persons who are members of the Class defined in paragraph 20 and who do not timely and validly request exclusion from the Settlement Class.
Settlement Class Members or “Class Members” means the set of members of the Class.
