Settlement Class Member definition

Settlement Class Member means a member of a Settlement Class.

Settlement Class Member means a Person who falls within the definition of the Settlement Class as set forth above and who has not submitted a valid request for exclusion.

Settlement Class Member means each person and entity who or which is a member of the Settlement Class.

• Any Settlement Class Member who does not provide a timely notice or who does not provide all information required by this Settlement to exclude itself shall be bound by the terms of the Settlement, including all releases in the Settlement.

• Further, upon the Effective Date, and to the fullest extent permitted by law, each Settlement Class Member, including Plaintiffs, shall, either directly, indirectly, representatively, as a member of or on behalf of the general public or in any capacity, be permanently barred and enjoined from commencing, prosecuting, or participating in any recovery in any action in this or any other forum (other than participation in the settlement as provided herein) in which any of the Released Claims is asserted.

• Each Settlement Class Representative and Participating Settlement Class Member shall be solely responsible for the federal, state, and local tax consequences to him, her or it of the receipt of funds from the Settlement Fund pursuant to this Agreement.

• No later than fourteen (14) days after entry of the Preliminary Approval Order, CSI shall provide the Claims Administrator with the name, email address (where available), and last known physical address of each Settlement Class Member (collectively, “Class Member Information”) that CSI possesses.

• All putative Settlement Class Members who wish to opt out of the Settlement Class must do so by sending a written request for exclusion to the Settlement Administrator by first-class mail as outlined in the Notice Package, signed by the putative Settlement Class Member, and providing all required information.

More Definitions of Settlement Class Member

Settlement Class Member means each member of the Settlement Classes who has not timely elected to be excluded from the Settlement Classes.

Settlement Class Member means a member of the Class, as either a Participating Class Member or Non-Participating Class Member (including a Non- Participating Class Member who qualifies as an Aggrieved Employee).

Settlement Class Member means any one of, and “Settlement Class Members” means all of, the members of the Settlement Class.

Settlement Class Member means any member of the Settlement Class.

Settlement Class Member means each member of the settlement class, as defined in Section III of this Agreement, who does not timely elect to be excluded from the Settlement Class.
