Service activities definition

Service activities means activities in connection with the provision of personal, continuing services to shareholder accounts in the Shares; provided, however, that if the National Association of Securities Dealers, Inc. (“NASD”) adopts a definition of “service fee” for purposes of Section 2830(b)(9) of the NASD Conduct Rules or any successor provision that differs from the definition of “service activities” hereunder, or if the NASD adopts a related interpretive position intended to define the same concept, the definition of “service activities” in this paragraph shall be automatically amended, without further action of the parties, to conform to the then effective NASD definition. Overhead and other expenses related to “distribution activities” or “service activities,” including telephone and other communications expenses, may be included in the information regarding amounts expended for these activities.

Service activities do not include the transfer agency-related and other services for which PaineWebber receives compensation under the Service Contract between PaineWebber and the Fund.

• For purposes of this Plan, "distribution activities" shall mean any activities in connection with Mitchell Hutchins' performance of its obligations under this Plan or the Contract that are not deemed "service activities." • For the purpose of administering this permit (including ascertaining that fees paid were correct and evaluating the propriety of the fee base), the holder agrees to make all of the accounting books and supporting records to the business activities, as well as those of sublessees operating within the authority of this permit, available for analysis by qualified representatives of the Forest Service or other Federal agencies authorized to review the Forest Service activities.

• Service activities include construction management and contracting services, and property services operations which include global corporate relocation, facilities management and residential brokerage services.

You agree to use your best efforts to support the asset value of the Fund to the extent consistent with the suitability requirements of your Customer. This Agreement does not require Dealer to hold Fund shares in street name or to provide shareholder accounting and record keeping services for any Customers who are beneficial owners of Fund shares. -------------------------------------------------------------------------------- 5. You shall furnish us and the Fund with such information as shall reasonably be requested by either the Trustees of the Fund or by us with respect to the fees paid to you pursuant to this Agreement.

Service activities means activities conducted to provide specialty mental health services when the definition of the service includes these activities. Service activities include, but are not limited to, assessment, collateral, therapy, rehabilitation, and plan development.
