Secured Notes Documents definition

Secured Notes Documents means any documents or instrument evidencing or governing any Secured Notes Obligations.

Secured Notes Documents means, collectively, the Secured Notes, the Secured Notes Indenture, each other Security Document (as defined in the Secured Notes Indenture), and all other agreements, documents, and instruments delivered or entered into in connection therewith (including any guarantee agreements, pledge and collateral agreements, intercreditor agreements, and other security documents).

Secured Notes Documents means collectively, the following (as the same now exist or may hereunder be amended, modified, supplemented, extended, renewed, restated or replaced in accordance with the Intercreditor Agreement): (a) the Secured Notes Indenture; (b) the Secured Notes, and (b) all other Notes Documents (as defined in the Secured Notes Indenture).

Examples of Secured Notes Documents in a sentence

• Confirmation of the Plan shall be deemed (i) approval of the New Secured Notes Documents, and all transactions contemplated thereby, and all actions to be taken, undertakings to be made, and obligations to be incurred by the applicable Reorganized Debtors in connection therewith and (ii) authorization to enter into and perform under the New Secured Notes Documents.

• It is acknowledged and agreed that (without prejudice to the extension of the Secured Obligations to any other Indebtedness from time to time included within the definition thereof) as at the date hereof, the Secured Obligations shall include: (a) all Liabilities under the Senior Facilities Agreement; and (b) all Liabilities under the Senior Secured Notes Documents.

• The Reorganized Debtors shall be authorized to execute, deliver, and enter into and perform under the New Secured Notes Documents without the need for any further corporate or limited liability company action and without further action by the holders of Claims or Interests.

• On the Effective Date, Reorganized Parent shall issue the New Secured Notes to Holders of April Convertible Notes Secured Claims on the terms set forth in the Plan and the New Secured Notes Documents.

• On the Effective Date, the New Secured Notes Documents shall be executed and delivered.

More Definitions of Secured Notes Documents

Secured Notes Documents means, collectively, the “Notes Documents” as defined in the Ravenswood Intercreditor Agreement and the “Noteholder Documents” as defined in the Muscle Shoals Intercreditor Agreement.

Secured Notes Documents means, collectively, the Indentures and all instruments, security agreements, collateral agreements, guaranty agreements, intercreditor agreements, pledges, and other documents with respect to the Secured Notes.

Secured Notes Documents means the Notes (including Additional Notes), the guarantees thereof, this Indenture and the Security Documents related thereto.

Secured Notes Documents means any Secured Notes, each indenture with respect to any Secured Notes and all collateral agreements or documents in respect of any Secured Notes (in each case as may be replaced, refinanced, amended, amended and restated, modified, supplemented, substituted, extended, renewed or restated from time to time).

Secured Notes Documents the “Notes Documents” under (and as defined in) the Secured Notes Indenture as of the Closing Date.

Secured Notes Documents means the Secured Notes, the Secured Notes Indenture, the Secured Notes Security Documents and all other documents executed and delivered with respect to the Secured Notes or the Secured Notes Indenture, as in effect on the Effective Date and as the same may be amended, modified and/or supplemented from time to time in accordance with the terms hereof and thereof.

Secured Notes Documents means, collectively, the Secured Notes Indenture and any security documents and any other collateral, guarantee, and ancillary documents executed in connection with the Secured Notes Indenture.
