Second Expansion Space definition

Second Expansion Space means, collectively, the Suites 150 and 170 Expansion Space (as defined below) and the Suite 203 Expansion Space (as defined below).
Second Expansion Space as defined in Section 36.1(a)(ii).
Second Expansion Space with respect to this ---------------------- Second Amendment shall mean that portion of the Building on the fourth (4th) floor of the Building consisting of approximately 25,493 rentable square feet which is demised hereunder by Landlord to Tenant and which is described and depicted on Exhibit A attached hereto and made a part hereof. The parties agree --------- that within ninety (90) days after the date hereof, the rentable square footage of the Second Expansion Space is subject to final field verification by Tenant, at Tenant's sole cost and expense, in accordance with the standards established by the Building Owners and Managers Association ("BOMA"), and that the rentals ---- based thereon will be adjusted, if necessary, accordingly and retroactively to the Second Expansion Space Commencement Date.

Examples of Second Expansion Space in a sentence

  • Tenant’s Notice to expand into the Second Expansion Space shall be delivered to Landlord on or before July 1, 2012 and shall specify the effective date of Tenant’s intended occupancy of the Second Expansion Space (the “Second Expansion Occupancy Date”).

  • The lease of the Second Expansion Space is subject to all of the terms and conditions of the Lease currently in effect, except as modified in this Amendment.

  • Delivery shall be deemed satisfied upon issuance of a certificate of occupancy on the Second Expansion Space and Landlord and Tenant agree to execute an Acceptance of Premises Amendment that shall establish actual delivery of the Second Expansion Space.

More Definitions of Second Expansion Space

Second Expansion Space means a full or a partial Mid-Rise Floor or High-Rise Floor, the size (which for a partial floor shall be not less than 30,000 Rentable Square Feet), and layout of which shall be designated by Landlord in the SES Availability Notice.
Second Expansion Space means that certain space containing, at Landlord’s election, between ten to fifteen thousand (10,000-15,000) rentable square feet of office space contiguous to the Premises, as same is constructed as of the Commencement Date, as designated by Landlord by notice to Tenant on or before six (6) months prior to the Delivery Date (as hereinafter defined) (“Landlord Expansion Notice”). Notwithstanding the foregoing, if Tenant has exercised the First Expansion Option, then the Second Expansion Space shall be space located on the ninth (9th) floor of the Building which is contiguous to the First Expansion Space (provided there is at least 10,000 rentable square feet of space located on the ninth (9th) floor which is not part of the First Expansion Space). Landlord’s Expansion Notice shall also specify (i) the delivery date of possession of the Second Expansion Space, which delivery date shall be within the sixty-first (61st) to seventy-second (72nd) month of the Term (“Delivery Date”), (ii) Landlord’s determination of the Fair Market Rental Value (as defined in Schedule 6, attached) applicable to the Second Expansion Space, (iii) any allowances or rent concessions being offered by Landlord with respect to the Second Expansion Space and (iv) the base year, if other than a full pass through, for Expenses, Common Area Charges and Taxes applicable to the Second Expansion Space.
Second Expansion Space shall consist of the balance of the fourteenth (14th) floor of the Building which shall consist of approximately 17,000 rentable square feet (after Tenant's exercise of the Second Expansion Option or if Tenant didn't exercise such Second Expansion Option, any portion of the fourteenth (14th) floor containing approximately 17,000 rentable square feet). If Landlord shall fail or be unable to give the Second Expansion Space Availability Notice on or before March 30, 2008, Tenant shall deliver written notice to Landlord stating such failure and demanding that Landlord deliver such notice, and Landlord shall promptly respond in writing to Tenant's demand, setting forth in reasonably sufficient detail the reasons for Landlord's failure or inability to deliver the Second Expansion Space Availability Notice. If Landlord has not, in good faith, delivered such Second Expansion Space Availability Notice by May 30, 2008, Tenant may deliver such First Expansion Space Availability Notice and seek all legal remedies, including an action for declaratory or injunctive relief or for any loss, injury or damage claimed by Tenant in connection with the failure or refusal by Landlord to deliver such notice (except that Landlord shall incur no liability whatsoever if the inability to deliver such notice is due to Force Majeure, but Force Majeure shall not include any rights or circumstances arising out of Landlord's previous acts or failings to act or of any rights granted to any tenant or occupant), which failure shall be considered to be an anticipatory breach by Landlord of this Article XIX.
Second Expansion Space means a portion of the Building commonly known as Suite 102, containing approximately 11,897 rentable square feet of area, and more particularly shown on Exhibit “A-2” attached hereto.
Second Expansion Space means a portion or portions of the Building, Plaza I, Plaza II, Plaza III, Plaza IV, Plaza V, Plaza VI, Xxxxx XXX, Xxxxx XXXX xx Xxxxx XX xxxxxxxxxx by Landlord in its sole discretion and containing approximately 70,000 RSF in a single contiguous block. Any dispute between Landlord and Tenant as to the RSF of the Second Expansion Space or the RSF of the building in which the Second Expansion Space is located pursuant to this Section if other than the Building shall be resolved in accordance with Section 2.01.
Second Expansion Space shall be contiguous to either the First Expansion Space beginning at gridlines R through P of Exhibit A and expanding forward, or if the First Expansion Space is not taken, then the Second Expansion Space shall mean contiguous to the current premises beginning at gridline R and moving forward through gridline P, and coinciding with quadrants 17 through 19. This Agreement is made and entered into as of September 19, 1996 by and between Health Management Systems, Inc., a New York corporation, and Health Care Microsystems, Inc., a California corporation (collectively, "Tenant"), and Pacific Corporate Towers LLC, a Delaware limited company ("Landlord"). Landlord and Tenant are entering into a lease of certain premises in the building located at 200 Xxxxx Xxxxxxxxx Xxxxxxxxx, El Segundo, California (the "Premises"). In connection with the lease ("Proposed Transaction"), Landlord has granted certain terms and conditions as an inducement to Tenant to enter into the Proposed Transaction. Landlord would not have proposed these terms and conditions to Tenant without Tenant's agreement to keep such terms and conditions confidential. Tenant, and its agents, officers, shareholders, employees, advisors, contractors, affiliates and representatives (including, without limitation, brokers, accountants and attorneys)(collectively "Representatives"), will acquire various information relating to the terms and conditions of the Proposed Transaction. The parties desire to maintain the confidentiality of such information pursuant to the provisions of this Agreement.
Second Expansion Space means the approximately 109,941 square feet of Rentable Area which is located on the 10th and 11th floors of the Building and the Tower and which is depicted on Exhibit Q-2 that is attached to this Second Amendment.
