Scheduled Uptime definition

Scheduled Uptime means the total minutes in the reporting month less the total minutes represented by the Scheduled Downtime.
Scheduled Uptime means the total minutes in the Service Period. “Service Availability Credits” has the meaning set forth in Section 3.6(a). “Service Level Credits” has the meaning set forth in Section 4.2.
Scheduled Uptime means the total minutes in the Service Period.

More Definitions of Scheduled Uptime

Scheduled Uptime means the total time duration less time required for scheduled maintenance or scheduled upgrades.
Scheduled Uptime means the total minutes in the reporting month less the total minutes represented by the Scheduled Down- time.
Scheduled Uptime means the period of time (days of the week and hours per day) the Services are expected to be available to Company for normal business use. Scheduled Uptime excludes maintenance windows for the Services.
Scheduled Uptime will mean the aggregate number of hours in any month, during which each Application, Data Network, or Host System is scheduled to be available as determined by the net of the scheduled hours minus Scheduled Downtime.
Scheduled Uptime means any time during a Calendar month that is not Scheduled Downtime. “Available For Use” shall mean the ability of the Application Services to be utilized or accessed as contemplated under the Agreement(s), including conformance to the Specifications, and without material degradation of performance, but excluding Scheduled Downtime. In the event 99.9% Availability during Critical Hours for the Application Services is not achieved, but at least 98.0% Availability for the Application Services during Critical Hours is achieved, then the credits shall be incurred as follows: 10% of monthly Application Services fees for the first month, 15% of monthly Application Services fees for the second consecutive month, and 20% of monthly Application Services fees for the third consecutive month and each consecutive month thereafter. In the event at least 98% Availability for the Application Services during Critical Hours is not achieved, but at least 95.0% Availability during Critical Hours for the Application Services is achieved then the credits shall be incurred as follows: 20% of monthly Application Services fees for the first month, 25% of monthly Application Services fees for the second consecutive month, and 30% of monthly Application Services fees for the third consecutive month and each consecutive month thereafter. In the event at least 95% Availability during Critical Hours for the Application Services is not achieved, then the credits shall be incurred as follows: 20% of monthly Application Services fees for the first month, and 25% of monthly Application Services fees for the second consecutive month, 30% of monthly Application Services fees for the third consecutive month and each consecutive month thereafter. Scheduled Uptime and “Available For Use” shall each of the meaning defined above. “Availability”, for purposes of this paragraph 5.2.2, means the actual number of hours the Application Services are Available For Use during Scheduled Uptime in a given calendar month expressed as a percentage of Scheduled Uptime during a calendar month (i.e., Availability % = ((Number of hours the Application Services are actually Available For Use during Scheduled Uptime – Downtime during Scheduled Uptime)/(Number of hours the Application Services are actually Available For Use during Scheduled Uptime)) x 100%). In the event 97% Availability for the Application Services is not achieved, but at least 93% Availability for the Application Services is achieved, then the credits shall be incurred as follows: 20% of monthly Application Services fees for the first month, and 25% of monthly Application Services fees for the second consecutive month, and 30% of monthly Application Services fees for the third consecutive month and each consecutive month thereafter. In the event at least 93%% Availability for the Application Services is not achieved, then the credits shall be incurred as follows: 40% of monthly Application Services fees for the first month, and 45% of monthly Application Services fees for the second consecutive month, and 50% of monthly Application Services fees for the third consecutive month and each consecutive month thereafter. Scheduled Uptime means the total minutes in the reporting month less the total minutes represented by the Scheduled Downtime. Service Level Standard. Services will be available to Authorized Users for normal use 100% of the Scheduled Uptime. Calculation. (Actual Uptime/Scheduled Uptime) * 100 = Percentage Uptime (as calculated by rounding to the second decimal point) Performance Credit. Where Percentage Uptime is greater than 99.98%, no Performance Credit will be due to County. Where Percentage Uptime is equal to or less than 99.98%, County shall be due a Performance Credit in the amount of 10% of the Services Fees (as calculated on a monthly basis for the reporting month) for each full 1% reduction in Percentage Uptime. Example Calculation. Assuming reporting month is February 2012 (41,760 minutes). Assuming a Maintenance Window of Sundays from Midnight to 4:00 a.m. Eastern Standard Time (equals Scheduled Downtime of 960 minutes). Scheduled Uptime equals 40,800 minutes (total minutes of 41,760 in February 2012 less 960 minutes of Scheduled Downtime). Assuming Actual Uptime of 40,000 minutes. A Percentage Uptime is calculated as follows: (40,000/ 40,800) *100 = 98.04%. The threshold of 99.99% less the Percentage Uptime of 98.04% = 1.95%. The difference is greater than a 1% reduction but is less than a 2% reduction; therefore, County is due 10% of the Services Fees as a Performance Credit.
