Schedule 1 offence definition

Schedule 1 offence means an offence specified in Schedule 1 of the BA for which a bail decision maker must refuse bail unless exceptional circumstances exist that justify the grant of bail. The Schedule 1 offences are listed in section 9.2.4 below.
Schedule 1 offence means an offence described in Schedule 1;
Schedule 1 offence means an offence mentioned in Schedule 1 to the Criminal Procedure (Scotland) Act 1995 (c.46) (offences against children under 17 years of age to which special provisions apply).

Examples of Schedule 1 offence in a sentence

  • A matter cannot be referred to a juvenile justice team if the offence is a Schedule 1 offence or a Schedule 2 offence.

  • Subsection (1) does not allow a member of the Police Force to caution a person instead of laying a charge if the offence is a Schedule 1 offence or a Schedule 2 offence.

  • If the court finds a young person guilty of an offence other than a Schedule 1 offence or a Schedule 2 offence and does not impose a custodial sentence, the court is not to record a conviction unless it is satisfied that there are exceptional reasons for doing so.

  • Sections 13(3) of the BA – providing that only a court may grant bail to a person accused of any Schedule 1 offence other than treason or murder – does not apply to an Aboriginal person in certain circumstances.

  • Schedule 1 offence means an offence against a Schedule 1 provision.

Schedule 1 offence. (附表1所列罪行) means-
Schedule 1 offence means an offence that is an arrestable offence33 and is specified in Schedule 1 of the Act. The specified acts are generally of a more serious nature; acts of ‘gross indecency’, for example, are not included.34 The role of the accused vis-à-vis the victim may be relevant, e.g. a person in authority, such as a teacher, would be liable for a greater sentence in respect of an offence on a pupil.35 The victim is excluded from the statutory requirement to report.
