Amounts described in this Section 4.3 that are subject to Yield Restriction as described above may be invested without Yield Restriction to the extent such amounts, in the aggregate, do not exceed the lesser of five percent (5%) of the Sale Proceeds of the Agreement or $100,000 (the “Minor Portion”).
The County reasonably expects (i) to spend or enter into binding contracts to spend at least 5% of the Net Sale Proceeds of the Agreement on costs of Capital Projects by March 20, 2023; (ii) to allocate at least 85% of the Net Sale Proceeds of the Agreement to costs of Capital Projects by September 20, 2025; and (iii) that the completion of the Projects and allocation of the Net Sale Proceeds of the Agreement to costs of Capital Projects will proceed with due diligence.
