  • Billings to Customers under these RRT Terms and Conditions shall be based on those meter readings and estimates.

  • This emerging Plan has been through Examination, and the Council is awaiting the final Examiner’s report.

  • No term or condition of these RRT Terms and Conditions shall be deemed to have been waived and no breach excused unless such waiver or consent to excuse is in writing and signed by the Party claimed to have waived or consented to excuse.

  • If an event or circumstance of Force Majeure occurs that affects ENMAX Energy’s ability to provide Regulated Rate Service or any other services provided under these RRT Terms and Conditions, so far as they are affected by the Force Majeure or its consequences, the Regulated Rate Service shall be suspended until the Force Majeure or its consequences are remedied, and for such period thereafter as may reasonably be required to restore the Regulated Rate Service.

  • The failure of either Party to insist in any one or more instances upon strict performance of any provisions of these RRT Terms and Conditions, or to take advantage of any of its rights hereunder, shall not be construed as a waiver of any such provisions or the relinquishment of any such right or any other right hereunder, which shall remain in full force and effect.
