Retail Channels definition

Retail Channels means any channel of distribution which reaches consumer customers, including, but not limited to: (i) retail outlets; (ii) retail nurseries and hardware co-ops; (iii) home centers (e.g., Home Depot or Lowes); (iv) mass merchants (e.g., Wal-Mart or Kmart); (v) membership or warehouse clubs (e.g., Sam's Club); (vi) the Internet and (vii) other current or future channels of trade which arise or become retail channels in the lawn and garden industry.
Retail Channels means and refers to all retail and wholesale distribution channels for Cartographic Products in North America. Specifically, retail and wholesale distribution channels shall refer to all available retail outlets for Cartographic Products in North America including, but not limited to, book stores (chains & independents), gift, museum and nature/discovery stores, map & travel stores, mass merchandisers (discount, drug & grocery), newsstands, office supply & stationery stores, outdoor sports stores, poster/framing shops, mail order and on-line retailers (including book clubs), and retail school supply & learning/entertainment stores; provided, however, that the NG stores and NG kiosks identified in the footnote to the table of rights in Section 2.2(a) shall be excluded from "Retail Channels."
Retail Channels means any store, establishment, or other distribution channel where the person(s) who purchase(s) the products do(es) so for immediate personal consumption. Retail Channels includes all airports, including those serviced by Westfield’s and HMS Host, but does not include locations serviced by Aramark or Centerplate (other than airports), US Food's distribution to Disney properties, or the sale of Products on a wholesale basis to grocery stores, convenience stores, and other similar establishments which do not resell the Products to customers in a restaurant, snack bar, kiosk, or other similar setting. By way of example, Cono Italiano shall retain the rights to sell the Products on a wholesale basis to Wal-Mart, Target, Rite Aid, CVS, Sam's Club, Costco stores, 7-11 stores, Wawa, Quick Check, or drug chains that sell "frozen" packaged products, so long as such entity does not then resell the Products in an in-store restaurant, snack bar, kiosk, or other similiar setting.
