Restricted Transfer definition

Restricted Transfer a transfer of Personal Data which is undergoing processing or which is intended to be processed after transfer, to a country or territory to which such transfer is prohibited or subject to any requirement to take additional steps to adequately protect the Personal Data processed under this Agreement for the transfer to be lawful under the Data Protection Legislation;

Restricted Transfer means: (i) where the EU GDPR applies, a transfer of Personal Data from the European Economic Area (“EEA”) to a Restricted Country; (ii) where the UK GDPR applies, a transfer of Personal Data from the UK to a Restricted Country; and (iii) where the Swiss Federal Act on Data Protection applies, a transfer of Personal Data from Switzerland to a Restricted Country.

Restricted Transfer means a transfer of Data from within an Origin Jurisdiction, or that is otherwise subject to Applicable Data Protection Law of an Origin Jurisdiction, to a Destination Jurisdiction;

More Definitions of Restricted Transfer

Restricted Transfer means any Transfer other than a Permitted Transfer.

Restricted Transfer means (i) a transfer of Controller Personal Data from Controller to Processor; or (ii) an onward transfer of Controller Personal Data from a Processor to a Sub Processor, or between two establishments of Processor, in each case, where such transfer would be prohibited by Data Protection Laws (or by the terms of data transfer agreements put in place to address the data transfer restrictions of Data Protection Laws);

Restricted Transfer means a transfer of Personal Data from the European Economic Area or UK (as applicable) to a country outside of the European Economic Area or UK (as applicable) which is not subject to an adequacy determination.

Restricted Transfer means the disclosure, grant of access or other transfer of Personal Data to any person, which would be prohibited without a legal basis therefor under Chapter V of the GDPR.

Restricted Transfer means a transfer of Customer Personal Data from Customer to a UKG Processor, or a transfer of such data between UKG Processors, where such transfer would be prohibited by Data Protection Laws (or by the terms of data transfer agreements put in place to address the data transfer restrictions of Data Protection Laws) in the absence of a Cross-Border Transfer Mechanism.

Restricted Transfer means a transfer of the Customer's Personal Data from Mailgun to a sub-processor where such transfer would be prohibited by EU Data Protection Laws (or by the terms of data transfer agreements put in place to address the data transfer restrictions of EU Data Protection Laws) in the absence of appropriate safeguards required for such transfers under EU Data Protection Laws.

Restricted Transfer means a transfer of Personal Data from an entity who is established in the United Kingdom and/or the European Union (as applicable) and/or whose processing of Personal Data under the Agreement is caught by the requirements of the GDPR, to an entity that processes the relevant Personal Data in a Restricted Country;
