Rest Breaks. Each employee shall be entitled to two fifteen (15) minute rest breaks during each work day's work shift. Clothing Allowance The Employer agrees to furnish the following items:
Rest Breaks. For twelve (12) hour shifts, an Employee shall commence and cease his/her shift at the designated stopping time and place. The Employee shall be provided with three (3) paid lunch/rest periods (2 x 15 minutes and 1 x 30 minutes) at the Employee’s designated lunch place between the third (3rd) and fifth (5th), the fifth (5th) and the seventh (7th), and the eighth (8th) and the tenth (10th) hours of the shift. The total lunch/rest period shall not exceed sixty (60) minutes. Flexibility in scheduling rest breaks may be necessary to meet urgent customer needs.

Rest Breaks. Employees shall be granted two (2) paid fifteen (15) minute rest breaks per work shift, one (1) break toward the middle of each one-half (1/2) work shift, at times designated by the Employer when the Employer determines that such breaks will not materially interfere with the rendering of services.

Supervisors may schedule rest breaks to accommodate operating requirements. If an employee is unable to take his/her rest break time, the employee must notify his/her supervisor. If an Individual Employer fails to provide an employee with a rest break(s) as provided herein, the employee shall be paid one hour at straight-time wages as a penalty for any day in which the employee was not authorized and permitted to take his rest period(s) as provided herein. An employee who voluntarily fails to take his rest period shall not be entitled to any penalty. All disputes concerning rest periods are solely and exclusively subject to the grievance procedure of this Agreement and must be brought to the attention of the Individual Employer in writing by the Union or employee within ten (10) calendar days after the Individual Employer’s regular pay day for any alleged violation of the rest period provision. Under no circumstances shall an Individual Employer be liable for more than one (1) rest break penalty per Employee per work day. Any penalties paid under this section shall neither include any fringe benefits nor be used in calculating overtime hours.

When occasioned by an emergency road call or scheduled work project or for any other reason where road crews are working in an area that does not provide access to restaurants, stores, etc, employees shall bring their lunch in portable food and beverage containers. Emergency Breaks to be scheduled two hours after start of shift and six hours after start of Road Crews: shift. When breaks are interrupted by trouble calls, breaks shall be taken as soon as possible after trouble call has ended. If the first break in a shift cannot be taken due to an interruption by a trouble call occurring one-half hour before the start of the lunch break, then the start of the first break may be deferred until fifteen minutes prior to the lunch break, and the first break and the lunch break may be taken consecutively. Lunch Breaks: Emergency crews shall have scheduled lunch breaks. Lunch breaks interrupted by trouble call may be resumed after trouble has been serviced. Lunch breaks that cannot be resumed shall be compensated at overtime rates if the employee works over eight hours during that shift.
