Replacement Supply definition

Replacement Supply means Natural Gas quantities obtained by Utility to replace the portion of a Scheduled Quantity that GASMARK fails to deliver in accordance with a Daily Nomination.

SECTION 2. Term This Agreement shall be effective for a period commencing on and including the Delivery Day of November 1, 2015, and expiring on and including the Delivery Day of March 31, 2020 (the "Primary Term"). Utility shall have the right, in its sole discretion, to extend the Agreement for a subsequent five (5) year term (with each such period referred to as a "Rollover Term") by providing written notice to UGIES of its intent to extend the Agreement at least one (I) year prior to the expiration of the Primary Term or any Rollover Tenn. If Utility elects to extend the Agreement for one or more Rollover Terms, the MDQ and all terms and conditions of service shall remain unchanged unless expressly agreed to by the Parties in writing; provided however, that the applicable Reservation Charge for the Rollover Term will be adjusted in accordance with Section 5.3 hereof. Examples of Replacement Supply in a sentence

  • The Company shall enter into the Replacement Supply Contracts with the Northwest Branded Sellers which accept the contracts as of the Effective Time.

  • At the Effective Time, the Company shall assign to Seller or its designee, the Existing Supply Agreement (as defined in the Consent Order) with respect to the Northwest Branded Sellers which do not accept the Replacement Supply Contracts.

  • Unless otherwise excused by the waiver of a delivery obligation under Section 3.5 or a Force Majeure Event under Section 7.2, if GASMARK fails to deliver all or a portion of a Scheduled Quantity on any day, GASMARK shall pay Utility (i) the positive difference between the cost of Replacement Supply and the applicable commodity charges for the undelivered quantity, and (ii) a liquidated damages charge of $75 per Dth applied against all undelivered quantities.

  • Buyer shall supply Seller with Replacement Supply Contracts (as defined in the Consent Order) acceptable to Buyer and authorize(s) Seller to offer such contracts to each Northwest Branded Seller (as defined in the Consent Order).

  • Replacement Supplier means any third party provider of Replacement Goods and/or Services appointed by or at the direction of the Authority from time to time;

  • Medical equipment supplier means any person, as defined in § 1-230, engaged in the delivery to the ultimate consumer, pursuant to the lawful order of a practitioner, of hypodermic syringes and needles, medicinal oxygen, Schedule VI controlled devices, those Schedule VI controlled substances with no medicinal properties that are used for the operation and cleaning of medical equipment, solutions for peritoneal dialysis, and sterile water or saline for irrigation.
