The Parties further agree that the Renewable Energy Projects set forth on Appendix A-2 hereto have satisfied the conditions to be added to the Program Documents as set forth in Section 4.6(c) of the Power Purchase Agreement, and accordingly, for all purposes of the Program Documents, shall constitute Section 4.6(c) Projects (and as such, Series 2011Projects) for Series 2011 Local Units at the Local Unit Facilities so enumerated.
The Company and the Holding Company hereby certify that as of the date hereof, the Company Parties do not have access to, and do not reasonably anticipate future access to, any source of funds relating to the Renewable Energy Projects, exclusive of (i) any funds received by the Company Parties to perform operations and maintenance or asset management services (if applicable); and (ii) those funds expressly addressed in the Settlement Agreement or this Consent No. 3.
Reporting Requirements: • Implementer shall report on the status of Renewable Energy Projects in monthly reports.
