  • The Parties shall keep the terms and provisions of this Agreement strictly confidential and shall not disclose them, in whole or in part, provided that the Parties may disclose to El Paso the fact that they have entered into an agreement to acquire the Permanently Released Capacity, for purposes of satisfying El Paso's creditworthiness requirements and obtaining El Paso's consent to the assignment of the Permanently Released Capacity.
