Refuse to Submit means that the individual (1) fails to provide blood, or an adequate amount of blood, for testing without a valid medical explanation after he or she has received notice of the requirement for alcohol testing in accordance with the Medical Center's policy; (2) fails to provide urine or an adequate amount of urine, for drug testing without a valid medical explanation after he or she has received notice of the requirement for urine testing in accordance with the Medical Center's policy; (3) engages in conduct that clearly obstructs the testing process; (4) fails to complete the drug and/or alcohol testing forms; or (5) does not report directly to the collection site after notification or delays the collection or testing process.
Refuse to Submit to a drug or alcohol test means that a driver fails to provide adequate breath for alcohol testing or fails to provide adequate urine for drug testing, or engages in conduct that clearly obstructs the testing process. Refusal to submit shall be considered a "positive" test result.
