Refined Coal definition

Refined Coal means refined coal produced at the Facility from coal.
Refined Coal means a liquid, gaseous, or solid fuel produced from coal by the Facilities that produces, upon sale to an Unrelated Person, a Section 45 Credit.
Refined Coal means the coal-based solid fuel product that is eligible for Section 45 Tax Credits and produced by Producer at the Facility while it is located on the Facility Land.

Examples of Refined Coal in a sentence

  • Commencing on the Effective Date and continuing until the expiration of the Term, in consideration of Generator’s grant of the Licenses and the provision of the Services and the infrastructure and connections necessary to make the Services available to Producer, Producer agrees to pay Generator a payment equal to per Ton of Refined Coal produced using the Facility and sold by Producer to Generator or a Third Party (the “License and Services Fee”).

  • In addition, Producer need not agree to any remedial action (and may terminate any remedial action agreed to) that Producer believes, in its sole discretion, could impair or jeopardize the ability of the Refined Coal to qualify for Section 45 Tax Credits.

  • Notwithstanding any provision of this Agreement to the contrary, the Delivery Point for the Refined Coal sold pursuant to this Section (if any) will be at, and title and risk of loss, damage or destruction with respect to such Refined Coal will pass to Generator at, the location of such Refined Coal at the time of such sale.

  • Generator shall be solely responsible for all Third Party Impositions relating to Resold Coal or Refined Coal that arise at or after any transfer of title to such Resold Coal or Refined Coal to Generator hereunder, and Generator shall, to the extent permitted by Law, indemnify Producer for, and hold harmless Producer in respect of, all such Third Party Impositions.

  • By way of example but not of limitation, Producer will be solely responsible for ensuring that the quality of the water provided for the Facility is suitable for the Facility’s operations or for producing Refined Coal.


More Definitions of Refined Coal

Refined Coal means solid synthetic fuel produced by utilization of the Process.

"Republic Investor" has the meaning set forth in the introductory paragraph hereof. "Republic Purchase Agreement" has the meaning set forth in Recital E. 12
