Examples of Recital A in a sentence

  • If the total cost of the Investment at completion by the final date specified in the Technical Description falls below the figure stated in Recital (A) so that the amount of the Credit exceeds 50% (fifty per cent.) of such total cost, the Bank may forthwith, by notice to the Borrower, cancel the undisbursed portion of the Credit and/or demand prepayment of the Loan Outstanding up to the amount by which the Credit exceeds 50% (fifty per cent.) of the total cost of the Investment.

  • In the event that Employee or the escrow agent is required to return all or a portion of the funds due under this agreement to or for the benefit of the Company or its creditors, Employee shall be permitted to assert a claim against the Company for amounts Employee can establish to be due to Employee pursuant to those items noted in Recital A and Section II above, but no others.

  • The Borrower undertakes to maintain the registration of the Vessel under the flag stated in Recital (A) for the duration of the Facility Period unless the Lender agrees otherwise in writing.

  • This agreement replaces the Recital A Benefits to the extent governing Employee.

  • In the event that a court finds in a final judgment that the substance of this Agreement is not enforceable, then the Employee shall have a right to assert a claim against the Company for amounts Employee can establish to be due to Employee pursuant to those items noted in Recital A, as well as to other Company benefits to which the Employee is entitled pursuant to law or contract.
