Receiving Works definition

Receiving Works means the Port of Discharge or the Facilities, whichever is applicable.
Receiving Works means the smelter receiving and processing the Concentrates.
Receiving Works means the premises of the Purchasers’ final customer for the Concentrate.

  • In case of partial loss of the Concentrates in any cargo delivered at the Receiving Works prior to weighing, sampling and moisture determination at the Receiving Works, the final invoice shall be based upon (i) the dry weight as determined at the time of loading and (ii) the weighted average of the final assays for copper, gold and silver, (as ascertained by assay in accordance with Article 13 of this Agreement) as determined from the portion of such cargo safely delivered to Buyer.

  • Weighing, sampling and determination of moisture for each cargo shall be carried out in accordance with accepted industry standards and with reliable modern equipment (i) by Seller at Seller's expense at Seller's Port of Loading and (ii) by Buyer at Buyer's expense at the Receiving Works.

  • In case of (i) total loss or damage of the Concentrates at any time prior to weighing, sampling and moisture determination at the Receiving Works, or (ii) a total or partial loss or damage of the Concentrates in any cargo delivered at an alternate port at any time, the final invoice shall be based upon full dry weights and assays as determined at time of loading.

  • Subject to Section 11.5, the dry weight as determined at the Receiving Works shall govern for the purpose of final settlement of the price for each cargo.

  • From the samples taken in accordance with Article 12 at the Receiving Works, assays for copper, gold and silver, respectively, shall be made independently by the respective assayers of Seller and Buyer, and the results of such assays shall be exchanged simultaneously on a lot by lot basis within 40 days from time of sampling.

  • Unless otherwise mutually agreed, Seller shall be entitled to have not more than two of its own representatives present, or at its own expense to be represented by an independent weigher and sampler, at the Receiving Works, and Buyer shall be entitled to have not more than two of its own representatives present, or to be represented at its own expense by an independent weigher and sampler, at Seller's Port of Loading.

  • Final settlement shall be made and final invoice paid by Buyer to Seller according to Article 8, as soon as all necessary details are available based on weights and moistures of the undamaged Parcel at Receiving Works as per Article 9 and assays as per Article 10.

  • All Concentrate delivered to Buyer under this Agreement shall be smelted at the Receiving Works.

Related to Receiving Works

  • The Works means the work or works to be executed or done under this contract.

  • Receiving Party Personnel has the meaning set forth in Section 37(d).

  • Custom Materials means Materials developed by the Supplier at the Procuring Entity's expense under the Contract and identified as such in Appendix 5 of the Contract Agreement and such other Materials as the parties may agree in writing to be Custom Materials. Custom Materials includes Materials created from Standard Materials.

  • Receiving Party means a Party receiving confidential or proprietary information from the Disclosing Party.

  • Client Materials means [all works and materials supplied by or on behalf of the Client to the Consultant for incorporation into the Deliverables or for some other use in connection with the Services];

  • Contractor Materials means Materials owned or developed prior to the provision of the Work, or developed by Contractor independently from the provision of the Work and without use of the Court Materials or Confidential Information.

  • Study Materials means all the materials and information created for the Study, or required to be submitted to the Sponsor including all data, results, Biological Samples, Case Report Forms (or their equivalent) in whatever form held, conclusions, discoveries, inventions, know-how and the like, whether patentable or not, relating to the Study, which are discovered or developed as a result of the Study, but excluding the Institution’s ordinary patient records.

  • Developed Materials means Materials created, made, or developed by Contractor or Subcontractors, either solely or jointly with the Judicial Branch Entities or JBE Contractors, in the course of providing the Work under this Agreement, and all Intellectual Property Rights therein and thereto, including, without limitation, (i) all work-in-process, data or information, (ii) all modifications, enhancements and derivative works made to Contractor Materials, and (iii) all Deliverables; provided, however, that Developed Materials do not include Contractor Materials.

  • Project Materials means any and all works of authorship, artistic, literary and other works, inventions and materials designed, created, developed, written or prepared by the Supplier (or the Supplier's Personnel) in the course of providing the Services, whether individually, collectively or jointly with the Purchaser and on whatever media;

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).

  • Third Party Materials means materials and information, in any form or medium, including any software, documents, data, content, specifications, products, related services, equipment, or components of or relating to the Solutions that are not proprietary to CentralSquare.

  • Customer Materials any materials, data, information, software, equipment or other resources owned by or licensed to You and made available to Us pursuant to facilitating Your use of the Services, including Customer Data.

  • Discloser means the party disclosing Confidential Information.

  • Developed Software means software specifically designed for the Principal under the Contract. Depending how advanced its development is, it may be either a Product or a Service or both.

  • Confidential Materials means all tangible materials containing Confidential Information, including without limitation written or printed documents and computer disks or tapes, whether machine or user readable.

  • Proprietary Materials means any tangible chemical, biological or physical research materials that are furnished by or on behalf of one Party to the other Party in connection with this Agreement, regardless of whether such materials are specifically designated as proprietary by the transferring Party.
