Real Property Mortgage Agreement means the Peruvian law governed mining concessions and other rights mortgage agreement dated as of January 11, 2013, as amended on January 7, 2014, as amended and restated on June 2, 2014, and as amended and restated on March 30, 2016 (Segunda Modificación Integral al Contrato de Hipoteca Sobre Inmuebles), as amended on July 14, 2017 and on the date hereof, and as further amended from time to time, by HB Peru SAC in favor of the Peruvian Collateral Agent, for the benefit and in representation of the Secured Parties.

  • Fee Mortgage Any mortgage, pledge agreement, security agreement, assignment of leases and rents, fixture filing or similar document creating or evidencing a lien on Landlord’s interest in the Leased Property or any portion thereof (or an indirect interest therein, including without limitation, a lien on direct or indirect interests in Landlord) in accordance with the provisions of Article XXXI hereof.

  • Ground Leases Those certain leases with respect to real property that is a portion of the Leased Property, pursuant to which Landlord is a tenant and which leases have either been approved by Tenant or are in existence as of the date hereof and listed on Schedule A hereto.

  • Facility Mortgage As defined in Section 13.1.

  • Existing Mortgage has the meaning specified in Section 5.02(a)(vi).
