Qualifying Employer Security definition

Qualifying Employer Security means the Class A and Class B common stock of the Company.
Qualifying Employer Security means stock of the Employer or a marketable obligation of the Employer, as defined in ERISA Section 407.
Qualifying Employer Security means the common stock issued by the Employer which is tradable on an established securities market, or any other securities of the Employer which meet the requirements of Code Section 409(l) and are specified in writing to the Plan Administrator by the Employer.

  • Except as required by ERISA, the Trustee shall (a) follow all directions above referred to in this Section and (b) shall have no duty to exercise voting or other rights relating to any such security, Qualifying Employer Security or other asset.
