Putative Class Member means individuals included in the “Class Definition” provided in Plaintiffs Second Amended Class Action Complaint, with the exception of any employees of Defendants who were hired since September 2012 and who entered into or are subject to the Xerox Business Services Dispute Resolution Plan and Rules (“DRP”) that includes an individual arbitration agreement and class action waiver that bars their participation in this litigation.
Putative Class Member means a person who meets the definition of a member of the Settlement Class defined below, regardless whether such person has requested exclusion from the Class or whether the Class has been certified.

  • A Putative Class Member who opts out of the settlement may not object to the Settlement Agreement.

  • A Putative Class Member who does not submit a timely and valid Request for Exclusion (a “Settlement Class Member”) will have the right to object to the Class Settlement.

  • The Notice Packet shall also state the number of Workweeks credited to each Putative Class Member, Named Plaintiff, and Opt-In Plaintiff as a Settlement Class Member and/or as an Opt-In Plaintiff; and his or her estimated gross Individua l Class Settlement Share and/or Individua l FLSA Settlement Share based thereon.

  • Defendant shall not retaliate against any Putative Class Member or Opt-In Plaintiff for participating in or opting out of the Class Settlement.

  • Also excluded are UPS’s legal representatives, assigns, and successors; the Court and any member of its staff; and any Putative Class Member who timely submitted a valid Request for Exclusion or was found by the Court to have adequately opted out of the Class.

  • A claim must be filed under the Proposed Settlement by the Executor or Administrator of the Estate of the Putative Class Member.


More Definitions of Putative Class Member

Putative Class Member or “Putative Class Members” means any current or former non-exempt employee of Defendant working in Sprint’s retail establishments in the states of Arizona, Colorado, New York, Ohio, and Washington during the applica ble Settlement Period. Putative Class Members who do not opt out are Settlement Class Members and shall be bound by the terms of the Settlement Agreement.
Putative Class Member. “Putative Class Members,” “Class,” or “Class Members,” means any current and former hourly-paid or non-exempt employees employed by Defendant within the state of California during the applicable Settlement Period. Putative Class Members who do not opt out are a “Settlement Class Member” and shall be bound by the terms of the Settlement Agreement.
Putative Class Member shall include any individual who worked as a non-exempt traveler and received per diem for Defendant in Washington state at any time from February 18, 2019, until September 19, 2022. The total number of Putative Class Members is currently estimated to be 555.

Any fees or charges assessed against the Estates under section 1930 of chapter 123 of title 28 of the United States Code are excluded from the definition of Administrative Claims and shall be paid in accordance with Article V.N of the Plan. Notwithstanding anything to the contrary in this Plan, the filing of an Administrative Claim shall not be required in order to receive payment for any tax liability described in sections 503(b)(1)(B) and (C) in accordance with section 503(b)(1)(D) of the Bankruptcy Code.

  • Administrative Claim means a Claim for costs and expenses of administration of the Estates under sections 503(b), 507(a)(2), 507(b), or 1114(e)(2) of the Bankruptcy Code, including: (a) the actual and necessary costs and expenses incurred on or after the Petition Date of preserving the Estates and operating the businesses of the Debtors; (b) Allowed Professional Fee Claims in the Chapter 11 Cases; and (c) all fees and charges assessed against the Estates under chapter 123 of title 28 of the United States Code, 28 U.S.C. §§ 1911-1930.

  • Allowed Administrative Claim means an Allowed Claim that is an Administrative Claim.

  • Released Class Claims means the claims being released as described in Paragraph 6.2 below.

  • Administrative Claims Bar Date means the deadline for Filing requests for payment of Administrative Claims, which: (a) with respect to Administrative Claims other than Professional Fee Claims, shall be 30 days after the Effective Date; and (b) with respect to Professional Fee Claims, shall be 45 days after the Effective Date.

  • Administrative Claim Bar Date means the deadline for filing requests for payment of Administrative Claims, which shall be 30 days after the Effective Date.

  • Disallowed Claim means (a) a Claim, or any portion thereof, that has been disallowed by a Final Order or a settlement, (b) a Claim or any portion thereof that is Scheduled at zero or as contingent, disputed, or unliquidated and as to which a proof of claim bar date has been established but no proof of claim has been timely filed or deemed timely filed with the Bankruptcy Court pursuant to either the Bankruptcy Code or any Final Order of the Bankruptcy Court or otherwise deemed timely filed under applicable law, or (c) a Claim or any portion thereof that is not Scheduled and as to which a proof of claim bar date has been established but no proof of claim has been timely filed or deemed timely filed with the Bankruptcy Court pursuant to either the Bankruptcy Code or any Final Order of the Bankruptcy Court or otherwise deemed timely filed under applicable law.

  • Putative father means a man who is alleged to be or who claims to be the biological father of a child born to a woman to whom the man is not married at the time of the birth of the child.

  • Allowed Unsecured Claim means all or that portion of an Unsecured Claim which is an Allowed Claim.

  • Allowed Claim means an Allowed Claim of the type described.

  • Subclass With respect to the Class A-V Certificates, any Subclass thereof issued pursuant to Section 5.01(c). Any such Subclass will represent the Uncertificated Class A-V REMIC Regular Interest or Interests specified by the initial Holder of the Class A-V Certificates pursuant to Section 5.01(c).

  • Allowed Interest means an Interest in any Debtor, which has been or hereafter is listed by such Debtor in its books and records as liquidated in an amount and not disputed or contingent; provided, however, that to the extent an Interest is a Disputed Interest, the determination of whether such Interest shall be allowed and/or the amount of any such Interest shall be determined, resolved, or adjudicated, as the case may be, in the manner in which such Interest would have been determined, resolved, or adjudicated if the Chapter 11 Cases had not been commenced; and provided further, however, that proofs of Interest need not and should not be filed in the Bankruptcy Court with respect to any Interests; and provided further, however, that the Reorganized Debtors, in their discretion, may bring an objection or motion with respect to a Disputed Interest before the Bankruptcy Court for resolution.

  • Class C Member means a Member holding the Class C Ordinary Share.

  • Class Coupon The Class Coupon on each Class of Notes for any Accrual Period will be as set forth in Appendix I for Original Notes and Appendix II for MAC Notes.
