No failure of any part of the whole of any Purchased Services to be suitable for Your requirements shall entitle You to reject the Purchased Services or give rise to any right or claim against Us. Pre-contract representations made by or on behalf of Us shall only be relied upon by You if they are made in writing and are expressly reproduced and incorporated in this Agreement between Us and You.
You are responsible for providing and maintaining complete and accurate billing and contact information for the Timewatch Purchased Services.
You authorize Us and Our processing institution to charge such credit card or automatically withdraw from such designated bank account, as applicable, for all Purchased Services listed in the Order Form for the initial subscription term and any renewal subscription term(s) as set forth in Section 12.2. Such charges will be made in advance, as stated in the applicable Order Form.
All express and implied conditions and warranties as to quality, suitability or performance in relation to the Purchased Services and any amendments or enhancements undertaken are hereby excluded.
We shall not (a) modify Your Data, (b) disclose Your Data except as compelled by law or as expressly permitted in writing by You or (c) access Your Data except: i) to provide the Timewatch Purchased Services; ii) to collect performance metrics and other statistical information about the Subscription Services; iii) to prevent or address service or technical problems; or iv) at Your request in connection with customer support matters.
