Public Sector Operator means any person (other than a franchisee or franchise operator in relation to the services provided or operated under its franchise agreement) who provides railway passenger services or operates any station or light maintenance depot pursuant to or under Section 30 of the Act or Section 6 of the Railways Act 2005;

Public Sector Operator means the Awarding Authority, any subsidiary of the Awarding Authority, MPTS, the Secretary of State 18 or any other Government Authority established or exercising jurisdiction in the United Kingdom or any Affiliate of such a body and any other person (other than a franchise operator or a person providing passenger railway services on the Network under contract to the Awarding Authority in relation to the services provided or operated under its franchise, concession or operating agreement with the Awarding Authority) who provides railway passenger services or operates any station or light maintenance depot pursuant to or under section 30 of the Act, sections 211 or 213 of the Transport Act 2000 or sections 9 and 10 of the Transport Act 1968.

This term includes systems similar to separate storm sewer systems in municipalities, such as systems at military bases, large hospital or prison complexes, and highway and other thoroughfares. The term does not include separate storm sewers in very discrete areas, such as individual buildings.
