Promotions Transfers. VACANCIES 14.01 (a) The Employer shall post notices of vacancies for all regular and temporary positions within the bargaining unit not less than ten calendar days in advance of making an appointment. A copy of such notice shall be forwarded to the Union within five calendar days of the posting.
Promotions Transfers. For the purpose of this agreement, a promotion shall mean a change from one position to another position within the bargaining unit with a higher pay range and a transfer shall mean a change from one position to another within the bargaining unit which does not constitute a promotion.

If the Union has not advised the Company, in writing, within thirty (30) calendar days that it does not agree, then the job classification, job description and wage rate shall become a part of the existing Agreement. a. Within thirty (30) calendar days from the date the Union was notified in writing of the Company’s decision to implement a new job classification the Union may protest the wage rate and/or job description for the job classification by presenting and processing a grievance in the same manner as a policy grievance. If not settled during the grievance procedure the matter may be referred to Arbitration. The arbitrator shall have the authority to determine the appropriate wage rate and/or job description for the new job classification and shall have the authority to make the wage rate retroactive to the date of implementation. 21.3 Vacancies will be filled through the Job Preference System. When it is determined that a job vacancy is to be filled, and there are no qualified employees who are eligible for recall as provided by Article 22.11 as a result of a layoff, the Company will provide 24 hours notice to the Union of the intent to fill the vacancy before offering/awarding the vacancy to the senior qualified employee who has a Job Preference Form for the vacancy on file in the Administrative Office. Employees who are offered the position are expected to either accept or reject the position as soon as possible, but not later than the start of their next shift. Promotions Transfers. 6.1 Vacancies and promotions shall be filled by the most qualified applicant as determined by the Town; however, if qualifications are considered equal then seniority shall be the determining factor. The Town will make every effort to promote qualified employees from within the bargaining unit. 6.2 Notices for job vacancies for positions in the bargaining unit to be filled through a hiring or promotion process shall be submitted to the Union for posting on the Union bulletin boards for a period of at least ten (10) working days. 6.3 Vacancies in management positions which are excluded from the bargaining unit shall be submitted to the Union for posting on the Union bulletin boards, provided, however, that appointment to these positions shall not be subject to the grievance procedure of this Contract. In addition, employees who accept a promotion or voluntarily transfer to a position that is not covered under this Agreement shall cease being entitled to the benefits and other conditions of employment as set forth herein, except as otherwise set forth herein. 6.4 Whenever possible, the Town shall accommodate requests from existing employees for lateral transfers or voluntary demotions at the sole discretion of the Board of Selectmen, provided that no bargaining unit employees shall be involuntarily displaced or suffer from any changes in their Classification Seniority. The Town shall notify the Union in writing when such accommodations are approved; however the Town has no obligation to provide the Union with advance notice of vacancies for seasonal or temporary positions. 6.5 The Town reserves the exclusive right to make determinations on all hiring decisions, however, an employee who applied for and was not selected for promotion or transfer to a position that is part of the bargaining unit on the belief that he/she was equally qualified and has more Department Seniority than the candidate chosen may utilize the grievance procedures contained herein. 6.6 Job posting(s) shall include a description of duties to be performed, rate of pay, job location, hours of work and also if the job is included in the bargaining unit. 6.7 An employee who meets the minimum qualifications and is promoted to a higher level position shall be placed in a probationary status not to exceed six (6) months in the higher position. Promotions Transfers a. When vacancies occur in ▇▇▇▇▇▇▇ Controls, Inc. (AT&T Project), qualified employees by seniority will be given first consideration for the jobs. If the Company deems it necessary to promote or transfer a less senior person with higher qualifications, the matter shall be referred to the Advisory Committee, where the provisions of Article XXVIII apply. The Company will make every effort to make training available on a seniority basis and weigh abilities and qualifications of the senior employee. b. Should an employee decline a promotion or transfer, it shall have no effect on the employee's future promotions or transfers.
Promotions Transfers. The term promotion, as used in this provision, means the advancement of an employee to a higher paying classification. The Employer shall fill the openings by promoting/transferring from among the qualified applicants the employee with the longest continuous service provided all other factors are equal. In a circumstance where all factors considered for a promotional/transfer opportunity are equal between a present employee and an outside applicant, the first preference will be given to the present employee. Seniority, posted and recorded job qualifications, work performance evaluations as well as experience are factors which may be considered for promotions/transfers.
Promotions Transfers. In the event the Employer intends to permanently fill a Bargaining Unit job, the Employer agrees to post available positions within the bargaining unit on the appropriate bulletin boards. The posting shall remain for a minimum of five (5) calendar days prior to the filling of such positions unless an emergency requires a lesser period of time stated in the notice. Such notice will be electronically submitted to the Association as well. Where a promotional vacancy or a lateral vacancy in a Bargaining Unit job occurs and 2 or more Employees are under consideration for such vacancy, the Employer will promote or transfer the Employee with the greatest seniority, unless the most senior qualified employee lacks the qualifications, experience or ability to do the job. Disputes under this provision shall be subject to the Grievance Procedure. An Employee who is promoted will serve a Probationary Period of 520 straight time hours worked. If the Employee is removed from the new job during the Probationary Period, the Employee will be returned to their former job, if the job still exists, or a vacant job in the same classification without loss of seniority or other benefits, if applicable. If no vacancy exists, the employee shall first displace the least senior employee in their previous classification, if eligible. In the event there is no position for which the employee is eligible to displace in their former classification, they shall be displaced or laid off in accordance with Section 15.07 – Layoffs. Seniority for bidding purposes shall be by bargaining unit seniority.
Promotions Transfers. All appropriate vacancies will be advertised internally initially and externally if applicable. Promotions and transfers will be on the basis of demonstrated competencies and merit. Seniority will only be considered if all other things are equal. An unsuccessful applicant will be consulted by management as to the reason for the decision.
