Project Assumptions. We have made the following assumption in the preparation of this proposal: • Preliminary and ROW plan designs for the corridor are not included with this contract and will be performed with a supplemental agreement. • City will provide current AIMS data. • City will provide recent plats and pertinent right-of-way and easement data that are available and may not be reflected on AIMS. • The PES will be completed using survey as shown above. • No additional traffic operational analysis or safety analysis will be conducted or prepared with the scope of this project. All applicable traffic data will be taken/referenced from the 2022 Merriam Connected Corridor Plan. • Pavement design will follow the City of Overland Park standards for material and thickness and will not be independently developed or evaluated by Xxxxxx. • Utility relocations are currently unknown. If required, the relocations will be designed by the respective utilities or by supplemental agreement, including sanitary sewer. • No special floodzone permitting or modeling will be required other than what is specifically listed in the scope. • An individual 404 permit will not be required. • Permitting and mitigation fees will be paid by the client. • Xxxxxx will provide the Client PDF and CAD files on an online file exchange system. Exclusions: The following items, in addition to any items not specifically listed above are not included in this proposal but can be provided under a supplemental agreement: • Utility Design (electric, gas, comm/fiber) • Sanitary sewer design • Septic system design • Waterline system modeling • Concrete pavement design or joint layouts • Bridge/structural load ratings • Individual 404 permit • LOMR/CLOMR • Environmental investigation, permitting beyond those noted in the scope • Landscaping • 3D renderings and visualizations • Title work or ownership and encumbrance reports. • Right-of-way appraisals and negotiations • Construction observations, testing, and inspection • Hardscape, amenity, signage, monumentation, and sculpture design • Architectural services • Structural design • Irrigation Designs • Any services not specifically detailed in the scope. Project Assumptions are set forth in Appendix A – Project Assumptions attached hereto and hereby incorporated into the Contract (the “Project Assumptions”). Provider will provide, and has based its fees on satisfying, the In-Scope Services as described in the Project Assumptions. Any additional scope or system gaps not listed shall be deemed Out-of-Scope. If a new, required scope item is discovered, Provider will document the requirement, estimate and present the scope impact of addressing the new requirement to GLO, and if approved by GLO through the change control process set forth below, include it in the revised In-Scope Services. “Go-Live” refers to the date on which GLO uses the software programs specified in Software Appendix No. 3 to the MSLA (“SA 3”) in a production environment. Related to Project Assumptions

  • Incremental Assumption Agreement means an Incremental Assumption Agreement in form and substance reasonably satisfactory to the Administrative Agent, among the Borrower, the Administrative Agent and, if applicable, one or more Incremental Term Lenders and/or Incremental Revolving Facility Lenders.

  • Project Assets means all physical and other assets relating to (a) tangible assets such as civil works and equipment including foundations, embankments, pavements, road surface, interchanges, bridges, culverts, road over-bridges, drainage works, traffic signals, sign boards, kilometre-stones, [toll plaza(s)], electrical systems, communication systems, rest areas, relief centres, maintenance depots and administrative offices; and (b) Project Facilities situated on the Site;

Should the Project Plan conflict with the Contract in any way, the relevant provisions of the Contract, including any amendments, shall prevail.

  • Project Land means any parcel or parcels of land on which the project is developed and constructed by a promoter;

  • Projects means the projects identified in Exhibit A to the Agreement and all other projects, any costs of which are included in a Transitional Capital Plan pursuant to the Act or are Recovery Costs, and financed, by payment or reimbursement, with the proceeds of Bonds or Notes.

  • Project Plan means the document to be developed by the Contractor and approved by Webel Technology Ltd., based on the requirements of the Contract and the Preliminary Project Plan included in the Contractor’s bid. For the sake of clarity, the Agreed and Finalized Project Plan” refers to the version of the Project Plan submitted by the contractor after receiving the letter of Award and the same approved by Webel Technology Ltd. The project plan may be changed/ modified during the course of the project. Should the Project Plan conflict with the provisions of the Contract in any way, the relevant provisions of the Contract, including any amendments, shall prevail.
