Product Upgrade definition

Product Upgrade means a successor version of the Software that is made generally available to Licensee during a Maintenance Period. Subject to the terms and conditions hereof, Product Upgrades shall include, for example, the following:

  • Customer shall pay Affymetrix the purchase price of any Product Upgrades Customer elects to purchase at Affymetrix’ then current price for such Product Upgrade.


More Definitions of Product Upgrade

Product Upgrade means a change or new release of the Software and/or WorkWise Documentation designed to enhance the features of the Software or otherwise improve the functionality of the Software.

The term "Product Upgrade" does not include (a) new modules within a Product suite where such modules offer discrete new functionalities in addition to or together with the licensed applications, or (b) new software products released by SOFTRAX which may provide functionalities comparable to those provided by the Products but which are marketed as separate and discrete product alternatives from the Products.
