Product Sales definition

Product Sales means the total gross sales of the Product.
Product Sales means the aggregate gross amounts invoiced for the Product sold by the Company, its Affiliates or licensees of the Company and its Affiliates to third parties (other than the Company, its Affiliates or licensees of the Company and its Affiliates), including to distributors and end-users, less the following items (i) through (v) below as applicable to the Product sales to the extent actually taken or incurred with respect to such sales (the “Permitted Deductions”) and all in accordance with standard allocation procedures, allowance methodologies and accounting methods consistently applied, in accordance with GAAP (except as otherwise provided below):

Examples of Product Sales in a sentence

  • Issuance of a Tobacco Product Sales Permit shall be conditioned on an applicant’s consent to unannounced, periodic inspections of his/her retail establishment to ensure compliance with this regulation.

  • All tobacco products, as defined herein, shall be removed from the retail establishment upon suspension or revocation of the Tobacco Product Sales Permit.

  • A Tobacco Product Sales Permit will not be renewed if the permit holder has failed to pay all fines issued and the time period to appeal the fines has expired and/or the permit holder has not satisfied any outstanding permit suspensions.

  • Each applicant who sells tobacco products is required to provide proof of a current Tobacco Retailer License issued by the Massachusetts Department of Revenue, when required by state law, before a Tobacco Product Sales Permit can be issued.

  • Refusal to cooperate with inspections pursuant to this regulation shall result in the suspension of the Tobacco Product Sales Permit for thirty (30) consecutive business days.


More Definitions of Product Sales

Product Sales means the sale or distribution by the Company or any of its subsidiaries of drug or pharmaceutical products in the ordinary course of the Company’s or such subsidiary’s business.
Product Sales means the sum of, without any duplication:
Product Sales means the sale of the Products by Resourceco to the Customer.
Product Sales means the Products Sold in the Field in the Territory by Abbott directly to: (a) Dealers for Sale or resale to End Users; or (b) End Users; net of returns. Notwithstanding the foregoing, Products returned as a result of non-compliance with the warranties set forth in Section 3.4(f) shall be counted as Product Sales, it being understood that any replacement Products corresponding to such returned Products shall not be included in Product Sales.
Product Sales means the total annual dollar value of Sales for the Product at its most closely related Product Life Cycle stage;
Product Sales means the actual sum of money in the relevant quarter (net of sales, use, value added or other excise taxes imposed or paid directly with respect to the sale, but without deductions for withholding tax) (x) invoiced by AGA AB, and its affiliates and Future Sublicensees to, or (y) received by AGA AB and its affiliates and Existing Sublicensees from, Persons other than AGA AB and affiliates of AGA AB, of any nitric oxide product, or any product related thereto, in each case licensed under any of the Anaquest Agreement, the Expanded Agreement or the AGA License Agreement (the “Nitric Oxide Product”). For purposes of this definition, Product Sales shall be determined in accordance with generally acceptable accounting principles in the United States, consistently applied. The following paragraphs (a) and (b) shall further govern the determination of Product Sales under this Exhibit 2.3.
Product Sales is equal to total product revenues excluding development and licensing revenues on a basis consistent with such amounts as reported in Schedule K of the Historical Limited Review Accounts and Draft Limited Review Accounts; "Purchaser's Accountants" PricewaterhouseCoopers LLP;
