Nothing in this Section shall be interpreted to hold a Prime Contractor liable for any discriminatory practice of its subcontractors.
As areas and systems of a Covered Project are inspected and construction is tested by the Prime Contractor and accepted by the Public Owner, this Agreement shall not have further force or effect on such items or areas, except when the Prime Contractor is directed by the Public Owner to engage in repairs, modifications, and checkout and/or warranty functions as required in the Prime Contract for a Covered Project, unless these tasks are specifically excluded elsewhere in this Agreement.
Prime Contractor: Any person, firm, partnership, corporation, association, or joint venture as herein provided which has been awarded a City contract.
An employee of a Prime Contractor or Subcontractor shall be deemed a Core Employee if he or she has been on that Prime Contractor or Subcontractor’s payroll a minimum of 500 hours in the six months prior to a Covered Project, and on that Prime Contractor or Subcontractor’s active payroll within the 60 calendar days prior to start of work on a Covered Project.
Each Prime Contractor and all Subcontractors performing Covered Work shall have a pre-job conference with each Union representing craft workers the Prime Contractor and Subcontractors intend to employ on the Covered Project not less than ten (10) working days prior to the commencement of performance of work on the Covered Project.
