Primary Servicer definition

Primary Servicer. Prudential Asset Resources, Inc., or any successor thereto (as primary servicer) appointed as provided in the Primary Servicing Agreement.

Primary Servicer s rights and obligations shall expressly survive a termination of Master Servicer's servicing rights pursuant to the Pooling and Servicing Agreement (except a termination of Master Servicer caused by a Primary Servicer Default). Examples of Primary Servicer in a sentence

• The date or dates under the related Servicing Contract on which a Primary Servicer or Subservicer is required to transfer amounts in the Custodial Account to the Master Servicer or the Trustee for deposit to a Certificate Account.

• Each of the Primary Servicer and the Master Servicer is entitled to reimbursement of Servicing Advances made by it from collections received from the related Borrower or otherwise with respect to the related Mortgage Loan and Mortgaged Property or Supplemental Collateral, including interest on such Servicing Advances to the extent that interest on the amounts advanced is collected from the Borrower pursuant to the Mortgage Documents.

• If a defaulted Mortgage Loan is covered by Mortgage Insurance, the Primary Servicer will assign the Mortgage Loan or the related REO Property to the insurer, guarantor or other third-party provider of the Mortgage Insurance, if such Person so requires, within the time required to obtain the benefits of the Mortgage Insurance.

• Amounts held by a Primary Servicer in a Custodial Account are also subject to any additional limitations under the Servicing Contract, including the Primary Servicer’s responsibility for any fees or penalties for withdrawals.
