Power of Decision definition

Power of Decision means a power or right, conferred by or under this By-law and the Administrative Penalty By-law, to make a decision deciding or prescribing the legal rights, powers, privileges, immunities, duties or liabilities of any Person:
Power of Decision means a power or right, conferred by or under this By-law, to make a decision deciding or prescribing, the legal rights, powers, privileges, immunities, duties or liabilities of a Person;(a)in the case of a Screening Officer, in respect of a request to review anAdministrative Monetary Penalty;(b) in the case of a Hearings Officer, in respect of a request to review aScreening Decision;
Power of Decision means a power or right, conferred by or under the Administrative Monetary Penalty By-law, to make a decision about or prescribing the legal rights, powers, privileges, immunities, duties or liability of any Person;

Examples of Power of Decision in a sentence

  • No person shall attempt, directly or indirectly, to communicate for the purpose of influencing a Screening Officer or a Hearing Officer respecting the determination of a matter respecting a Delegated Power of Decision in a proceeding that is or will be pending before such officers, except the Contravener who is entitled to be heard in the proceeding, or the Contravener’s authorized agent, and only during the screening or hearing of the proceeding relating to the matter.

  • Substantial Taking means a Taking of at least 15% of the Land or Improvements which, in Lessee’s and Lessor’s reasonable judgment, will materially and adversely interfere with any development or use of the Premises that Lessee is then conducting or intends in good faith to conduct in the future.
