Phase II ESA definition

Phase II ESA has the meaning set forth in Section 5.17(b).
Phase II ESA collectively, the “ESAs”). A Phase II ESA consists of further investigation of recognized environmental conditions identified in the Phase I ESA including sampling and analysis of soil and groundwater necessary to determine whether or not contamination has occurred. Seller’s consent to conduct a Phase II ESA shall not be unreasonably withheld, conditioned or delayed. If Seller permits Purchaser to conduct a Phase II ESA, Seller will be provided a copy of the Phase II ESA within five (5) business days of completion and receipt by Purchaser. Any subsequent amendments and/or reports relating to the Phase II ESA shall also be delivered to Seller and Purchaser.
Phase II ESA means an ASTM E1903-11 Phase II Environmental Site Assessment.

Examples of Phase II ESA in a sentence

  • Phase II ESA is required to evaluate Recognized Environmental Conditions (REC) identified in the Phase I or other RECs identified by TMD staff.

  • Staff review of this Phase I ESA will determine if a further investigative Phase II ESA is also required.

More Definitions of Phase II ESA

Phase II ESA means a Phase II Environmental Site Assessment, if any, performed at a Property in accordance with the scope and recommendations of the applicable guidelines and standards for such site assessments issued by the ASTM.

Phase II ESA means the collection of subsurface (e.g., soil, sediment, groundwater or surface water) or indoor air samples necessary in order to determine if a REC identified in a Phase I ESA Conformed Copy through Second Amendment dated October 7, 2011 and resulting from the operation of the Facility or Equipment has or may have caused a Release of Hazardous Substances at the Site, except for de minimis and surficial Releases to a non-pervious surface or to soil or Releases authorized by an Environmental Permit.
