Phase II Environmental Site Assessment definition

Phase II Environmental Site Assessment means an investigation of all potential areas of concern identified in the Phase I Environmental Site Assessment for the purpose of determining if a Release of any substance has occurred.

Phase II Environmental Site Assessment or “Phase II” means an investigation performed in accordance with ASTM International’s Standard Practice for Environmental Site Assessments: Phase II Environmental Site Assessment Process (E 1903), as amended.

Phase II Environmental Site Assessment means an assessment of a site to physically confirm that contamination exists in potential or known areas of environmental contamination identified in the Phase I environmental assessment, but not to determine the nature, degree and extent of contamination. This assessment may include field sampling of media, laboratory anal- ysis of samples and visual confirmation of environmental contam- ination at the site.

• The Administrative Agent shall have received, in form and substance reasonably satisfactory to it, all existing environmental reports (including all available Phase I Environmental Site Assessment reports and Phase II Environmental Site Assessment reports), and such other reports, audits or certifications in the possession of the Credit Parties as it may reasonably request.

• Notwithstanding the foregoing, Purchaser shall not conduct any invasive testing or Phase II Environmental Site Assessment on any Owned Real Property or facilities subject to Branch Leases, without the prior written consent of Seller (which consent will not unreasonably be withheld or delayed) and coordinating the scope of such work with Seller or Seller’s consultants, as applicable.

Phase II Environmental Site Assessment. (Phase II ESA) means an Environmental Investigation, which at a minimum, is conducted by an Environmental Professional in accordance with the most recently adopted standard for a Phase II ESA process established by ASTM International, currently ASTM E1903-97 (2002). SBA will recognize a Phase II ESA conducted in accordance with generally-accepted industry standards of practice and consisting of a scope of work that would be considered reasonable and sufficient to identify the presence, nature, and extent of a Release.

Phase II Environmental Site Assessment means an invasive environmental site assessment undertaken in accordance with the most current ASTM Standards where soil samples are taken and analyzed for environmental contaminants.

Phase II Environmental Site Assessment means an assessment of a site to physically confirm that contamination exists in potential or known areas of environmental contamination identified in the Phase I environmental assess- ment, but not to determine the nature, degree and extent of contamination.

Phase II Environmental Site Assessment means any Phase II environmental site assessment as defined by ASTM Standard E1903-11, or any similar assessment of Environmental Conditions.

Phase II Environmental Site Assessment means the in situ sampling and laboratory analysis of any contamination discovered in connection with a Phase I Environmental Site Assessment, in a manner consistent with the current standards and practices employed typically by State Registered Environmental Assessors, or other professionals licensed in the State as engineers or geologists, performing environmental assessments in the same general geographic location as the Facility.

Phase II Environmental Site Assessment is defined in Section 4.2.

Phase II Environmental Site Assessment has the meaning set forth in Section 6.1(a).
