If the assessment costs less than the amount of the deposit, and if the Phase I Environmental Assessment does not identify areas of concern that in Company’s reasonable judgment indicate that further investigation is required, Company shall, no later than 30 Days after payment in full of the cost of the Phase I Environmental Assessment, return to Seller a sum equal to the amount by which the deposit exceeds the actual costs of such assessment.
Buyer may, at Buyer’s sole cost and expense, perform investigations, reasonably deemed necessary by Buyer in its sole discretion, to ascertain the environmental condition of the Property, including but not limited to a Phase I Environmental Assessment (the “Phase I”); easements; zoning; licenses; permits; approvals; geotechnical site assessment; and status of the title to the Property and the Easements (the “Investigations”).
Customer shall cooperate fully in connection with any such review, including bearing its own internal costs of such process, and will allow, or obtain, access to such systems, and records as ACUTRAQ may reasonably require for such review.
Buyer, at its sole expense, may obtain a Phase I Environmental Assessment of the Realty.
CASELLA shall accept delivery of the Premises in an “as is” state, subject to the completion of a Phase I Environmental Assessment to be undertaken by CASELLA by a qualified consulting firm acceptable to the CITY.
