Phase 2 Expansion definition

Phase 2 Expansion means the potential deepening of the shaft at the LDI Mine to access the lower Offset Zone.
Phase 2 Expansion means the construction of Phase 2 and lease of Phase 2 Built -up Area provided in Article 18 hereof. “Phase 2 Expansion Option” means the right of Lessee to require Lessor construct Phase 2 and lease the expanded Facility in Phase 2 to Lessee under the terms and conditions of this Contract, as more particularly described in Article 18 hereof. “Preliminary Design” means the document in Annex 2; Suzhou Fangzhen Construction/Metaldyne Pre-Lease Agreement 8
Phase 2 Expansion means the horizontal and vertical expansion of the Landfill to an elevation of up to 405 feet above MSL, as conceptually shown on the plan attached hereto as Exhibit A. The Phase 2 Expansion shall not extend horizontally beyond the Proposed Facility Boundary line as shown on Exhibit A and shall be no higher than 405 feet above MSL.

  • When/if MassDEP issues a conceptual approval for the Phase 2 Expansion at the beginning of the permitting process for the Phase 2 Expansion, however, the requirement for SHL to assume the obligation set forth in this Section shall not attach until an ATO is issued that provides capacity for the Phase 2 Expansion in the aggregate of 2 million cubic yards or more.

  • In the event that SHL does not receive an ATO for a Phase 2 Expansion, which shall be evidenced by the failure of SHL to procure an ATO by the date that MassDEP issues a Closure Approval for the Phase 1 Expansion, the parties shall instruct the Escrow Agent that all funds in the Post-Closure Escrow shall immediately be disbursed to the Town without setoff or deduction, and all such funds shall be so disbursed to the Town.

Related to Phase 2 Expansion

  • Phase 1 means the first implementation phase of this section, beginning June 1, 2018 and ending May 31, 2022.

  • Lateral expansion means a horizontal expansion of the waste boundaries of an existing MSW landfill. A lateral expansion is not a modification unless it results in an increase in the design capacity of the landfill.

If Tenant exercises this option, Tenant’s Expansion Space will be leased to Tenant in its “as is” condition and Tenant will, at its expense and in compliance with the provisions of Section 7.06, design and construct all Improvements desired by Tenant for its use and occupancy.
