Persistent Breach definition

Persistent Breach means a Default which has occurred on three or more separate occasions with a continuous period of six (6) months.

Persistent Breach means the CONTRACTOR is in any breach of this Contract or any part thereof continuously for twenty (20) Working Days or more. Personal Data has the same meaning as set out in the Data Protection Act 1998.

Persistent Breach means any breach of the Contract continuously for 30 Days or more or a breach of the Contract that occurs on more than one occasion and for the avoidance of doubt includes inadequate performance;

Examples of Persistent Breach in a sentence

• So long as the circumstances under the definition of Persistent Breach have occurred, any such declaration of anticipatory breach shall be valid, conclusive and binding, and such breach shall be deemed material even if such items comprising the Persistent Breach shall have been cured.

• Except for non- compliances with this Schedule by Project Co that constitute Persistent Breach, non-compliance with this Schedule by Project Co will not constitute a Project Co Material Breach and non- compliance with this Schedule by the Authority will not constitute an Authority Material Breach.

• Contractor Default is defined to include, amongst other things, a breach of the obligations which materially and adversely affects the performance of the services, is a Persistent Breach or where various Performance and Unavailability Deductions have been levied against the Contractor over a certain period.

• A Persistent Breach is defined as a breach where a Final Warning Notice has been served and the breach has continued for more than fourteen days or has recurred in three or more months over the next six months after the date of service of the Final Warning Notice.

• Except for non- compliances with this Schedule by Project Co that constitute Persistent Breach, non-compliance with this Schedule by Project Co will not constitute a Project Co Material Breach and non- compliance with this Schedule by the Authority will not constitute a material breach by the Authority.

More Definitions of Persistent Breach

Persistent Breach means repeated breaches of any of the terms of this Contract in such a manner as to reasonably justify the Authority’s opinion that the Supplier’s conduct is inconsistent with it having the intention or ability to give effect to the terms of this Contract.

Persistent Breach means a breach or series of breaches by Project Co of any term, covenant or undertaking to the Authority (other than a breach for which Deduction could be made) which, due to the fact that such breach has:

Persistent Breach means, pursuant to clause 49.1 (Persistent Breach), a breach for which a Final Warning Notice has been issued, which has continued for more than fourteen (14) Days or recurred in two (2) or more Months within the six (6) Month period after the date on which such Final Warning Notice is served on the Contractor;

Persistent Breach means a Default which has occurred on three or more separate occasions within a continuous period of six (6) months.

Persistent Breach means: (i) a particular breach which has recurred three (3) or more times in any rolling six (6) month period; or (ii) the occurrence of five (5) or more different breaches in any rolling six (6) month period; or

Persistent Breach means any breach of the Contract continuously for 30 Days or more or a breach of the Contract that occurs on more than one occasion and for the avoidance of doubt includes inadequate performance; "Requests for Information" shall have the meaning set out in FOIA or any apparent request for information under the FOIA or the Environmental Information Regulations.

Persistent Breach means a breach which has continued for more than fourteen (14) Days or occurred more than three (3) times in any six (6) Month period and which, following written notice by the Authority identifying the breach(es) and stating that it or they may result in termination if they recur or continue, continue for more than twenty (20) Days or recur in two (2) or more Months within the six (6) Month period after the date on which such notice is served on the Contractor;
